
A Georgia resident recently filed a Unum disability insurance benefits lawsuit, alleging that Unum wrongly denied her benefits.
According to the lawsuit, the plaintiff, Zargona Q., worked for Mission Essential Personnel, LLC, which provided Unum disability insurance benefits for its employees.
The Unum policy defines someone with a disability as being unable to perform the full, substantial duties of their occupation or career due to sickness or injury, and having a 20 percent or more loss in monthly earnings because of that sickness or injury.
Unfortunately, the plaintiff suffered from a cerebral aneurysm on November 13, 2012, which was followed by persistent headaches. While the policy provided Unum disability insurance benefits until April 2015, those benefits were denied from that point on.
The Unum disability insurance benefits claim denial stated that the plaintiff did not suffer severe enough limitations to qualify as disabled from a sedentary job.
However, two of the plaintiff’s doctors have reportedly stated that Zargona Q. is unable to work at her regular occupation because of her disability.
The plaintiff initially attempted to counteract this denial through administrative means, and appeal Unum’s decision to deny her Unum disability insurance benefits on August 31, 2015.
The appeal included a number of medical records to help the insurance company better understand her situation. Later, the plaintiff added a statement from her pain specialist, who wrote that the plaintiff’s disability prevents her from performing even sedentary work.
Though the plaintiff continuously provided more information to the defendants when they requested it, Unum once again denied the appeal on November 17, 2015.
Having exhausted her ability to fight the claim denial through administrative means, Zargona instead turned to filing a Unum disability insurance benefits lawsuit.
The disability benefits lawsuit alleges that Unum unjustly denied her disability benefits, violating the terms of ERISA, or the Employee Retirement Income Security Act.
