Plaintiff, Susan G., files a lawsuit against Unum Life Insurance Company, for no longer paying the plaintiff’s eligible disability benefits.
The plaintiff is a former legal secretary for law firm Baker Donelson Bearman Caldwell & Berkowitzafter. After being involved in a serious and life-threatening car accident, she is now filing claims for breach of contract, bad faith, and negligent infliction of emotional distress.
According to the Unum lawsuit, the plaintiff had allegedly suffered a severe and life-threatening car accident. When she was driving in the northbound lane on the I-55 in Jackson, Miss., an 18-wheeler tractor-trailer, driving southbound on the I-55, lost control of his vehicle and caused it to cross the barrier into the northbound lane.
Without any time to avoid the collision, she collided with the tractor-trailer head on, driving 70 miles per hour.
According to the Unum lawsuit, she suffered multiple injuries to her “head, neck, inner ears, back, shoulders, right arm, abdomen, ribs, left hip and right leg (multiple fractures).”
The Unum lawsuit maintains that she endured a lengthly hospitalization. Later, and because she was unable to perform any work, she filed a claim for disability benefits under the policy provide by her employer. Unum began paying her benefits under the plan.
However, Dr. L. Lee, the physician reportedly requested by Unum to do an independent medical examination, concluded that she was no longer disabled and can perform work.
According to her Unum lawsuit, “Dr. Lee’s report contains untrue and inaccurate statements that did not apply to plaintiff, her IME or her underlying medication conditions. Dr. Lee apparently confused plaintiff with other examinees and mixed up information in his report.”
Filing a Unum Lawsuit
Several people have recently filed Unum lawsuits claiming that the disability insurance giant failed to properly pay them disability benefits maintained under the terms of their insurance plans. They allege that the company unfairly denies their claims.
Susan’s claims, much like several others, allege that Unum Life Insurance Company unfairly denies their policyholders’ insurance benefits. Moreover, plaintiffs allege that the company purposely denies them their disability benefits to increase company revenue and profit.
In addition, there have allegedly been former employees of Unum that have stated similar accusations. They claim that the company purposely denies these disability benefits for no reason other than to increase company profits and to fulfill the company’s quota. They have allegedly even been instructed to deny insurance benefits to reach such goals.
Consumers who have been denied insurance benefits and have exhausted all other recourse are turning to file Unum lawsuits hoping to reverse their disability benefit denials.
The Unum Lawsuit is Case No. 3:17-cv-00615-CWR-LRA, in U.S. District Court for the Southern District of Mississippi, Northern Division.
