After being involved in a rear end collision, a Pennsylvania resident responded by filing a truck accident lawsuit against Performance Transportation and the truck’s driver.
The plaintiff, Rose Z., alleges that on April 26, 2018, she was involved in a rear end collision because of the negligence of the defendant and driver of a freight truck, Earl D. According to the lawsuit, Earl got distracted while driving and caused a rear end collision with Rose’s vehicle in front of him, causing her to lose control and drive off the roadway and into a tree.
The rear end collision caused serious injuries, the lawsuit claims, some of which are permanent in nature.
Because of the rear end collision, Earl allegedly received a citation for careless driving, to which he pled guilty and was charged a fine. The lawsuit not only names Earl as a defendant but his employer as well—Performance Transportation.
According to the lawsuit, Performance was “negligent and careless in maintaining the vehicle, in supervising the operator and in entrusting the vehicle to the defendant.”
Rose filed her rear end collision lawsuit on Aug. 6, 2018, in the U.S. District Court for the Eastern District of Pennsylvania. The lawsuit was filed on multiple counts, including negligence and vicarious liability. Rose’s husband, Joseph, also filed on one count of loss of consortium.
