Kidney dialysis patient lays down.For years, Fresenius Medical Care manufactured the most popular dialysis drugs in the United States (GranuFlo and NaturaLyte) while also maintaining the most dialysis centers. The core of many GranuFlo lawsuits is that Fresenius knew about the risks of cardiac-related deaths associated with the drugs, but attempted to keep those side effects hidden.

Kristine Staver filed a GranuFlo lawsuit on behalf of her late husband, John Staver, on Oct. 14, 2013. She’s one of many Americans who claim to have lost their spouse in a GranuFlo incident. The drug reportedly has a tendency to cause cardiac arrest, often resulting in death, and GranuFlo victims say they were never warned about the real dangers. Kristine was appointed as executor of John’s estate in April 2013. Like many people involved with GranuFlo lawsuits, it took years before Kristine found out that her husband’s death may not have been related to natural side effects of kidney dialysis.

Kristine says that the company’s “failure to disclose the defective nature of GranuFlo, the limited reach of its recall campaign, and the failure to notify the families of patients that suffered sudden cardiac death during dialysis of the association between GranuFlo and sudden cardiac death prevented Plaintiff from knowing that the death of John Staver was potentially related to the use of the defective GranuFlo product until August 2012.” Until that time, the family thought that John’s death was an unfortunate and non-preventable condition of his kidney dialysis.

Kristine is suing Fresenius for numerous counts, claiming that the company failed “in marketing and selling GranuFlo when it knew or should have known of its inherent design defects and in failing to properly and fully investigate prior incidents involving deaths related to the use of GranuFlo during dialysis.”

This lawsuit includes counts for breach of warranty, negligence and strict liability. Additionally, the GranuFlo lawsuit alleges that Fresenius “failed to correct known defects, and/or failed to recall, replace and/or provide post-sale warnings of the known defects and of the unreasonably dangerous nature of its product.”

The GranuFlo lawsuit is Kristine Staver, et al. v. Fresenius Medical Care North America, et al., Case No. 3:13-cv-107, in the U.S. District Court for the Southern District of Iowa.
