Wix class action lawsuit overview:

  • Who: Plaintiff Abrahim Mahallati filed a class action lawsuit against Wix.com Ltd.
  • Why: Mahallati claims Wix unilaterally raises subscription prices without consent and misrepresents that its services can be canceled “at any time.”
  • Where: The Wix class action lawsuit was filed in California federal court.

A new class action lawsuit alleges Wix unilaterally increases the price of its website subscription services without customers’ consent, then denies refunds despite telling consumers they can cancel at any time.

Plaintiff Abrahim Mahallati claims Wix advertises specific subscription prices to attract new customers, then changes the terms of the agreement after subscribers have already signed up and paid. 

According to the class action lawsuit, the company routinely raises renewal prices above the amount consumers originally agreed to pay without asking for their affirmative consent.

Mahallati further alleges Wix tells new customers their subscriptions can be canceled “at any time,” but that representation is misleading because refunds are only available within 14 days of a customer’s first purchase, a window that does not apply once a subscription has already renewed. 

As a result, the class action lawsuit claims consumers who discover they were overcharged during a renewal period have no way to recover their money.

Plaintiff alleges Wix overcharged subscription by $60

According to the Wix class action lawsuit, Mahallati signed up for Wix’s “Premium Plan Business Unlimited” in December 2021, paying $291.60 for his first year after a 10% discount. Wix allegedly emailed him confirming the subscription would renew for $324 the following December.

Instead, Mahallati claims he was charged $384 for his renewal, a $60 subscription overcharge above the price Wix had told him to expect. 

The charge also hit his account nearly two weeks before his actual renewal date, according to the complaint. By the time he noticed the subscription overcharge, Mahallati alleges he had already lost his 14-day window to cancel and receive a refund.

Mahallati wants to represent a class of California consumers who purchased one or more Wix subscriptions and were overcharged without their authorization. He demands a jury trial and seeks class certification, injunctive relief and restitution on behalf of himself and the class.

Similarly, Adobe faced allegations that its subscription practices violated the Restore Online Shoppers’ Confidence Act. The company recently agreed to pay $150 million to resolve the lawsuit brought by the U.S. Department of Justice.
