A new class action lawsuit accuses Winix of falsely advertising its air purifiers as having “True HEPA” filters.

Plaintiff Lukas Yant filed the class action lawsuit against Winix Global and Winix America on Oct. 20 in Illinois federal court, alleging violations of state and federal consumer laws.

Yant alleges in the lawsuit that Winix falsely advertises its air purifiers as having “True HEPA” filters, misleading consumers into paying a premium for products that do not meet the advertised standards.

Yant claims Winix has profited greatly from selling air purifiers with false HEPA claims, especially during the COVID-19 pandemic and recent wildfires, which have increased consumer demand for air purifiers.

Lawsuit: Winix air purifiers failed independent tests

The lawsuit alleges that Winix models 6300, P300, 5300, 5500, 5300-2, 6300-2, AM90, C909, 9800, C535 and C545, along with their replacement filters, were advertised as having “True HEPA” filters, which should capture at least 99.97% of airborne particles as small as 0.3 microns.

However, independent testing commissioned by Yant’s counsel allegedly showed that the filters used in these models do not meet HEPA standards. The lawsuit claims that consumers cannot independently verify the HEPA claims, making them reliant on Winix’s advertising.

The lawsuit further alleges that Winix’s false claims allowed the company to charge a premium for its products. HEPA filters are considered more effective and are generally more expensive than non-HEPA filters, Yant says. As a result, consumers paid more for Winix’s air purifiers than they would have if they had known the filters did not meet HEPA standards, he alleges.

Yant is looking to represent anyone who purchased a Winix 6300, P300, 5300, 5500, 5300-2, 6300-2, AM90, C909, 9800, C535, C545 or replacement filter during the applicable statutory period.

He is suing for breach of warranty, fraud, unjust enrichment and violations of Illinois consumer laws and is seeking certification of the class action, damages, fees, costs and a jury trial.

In 2024, a consumer filed a class action lawsuit accusing Antadi of falsely advertising its air purifiers as containing HEPA filters and meeting medical-grade filtration standards.

    I purchased 2 of the Wini x 5500-2 I wonder if they too are not accrete since the 5500 is NOT!! Can you let me know. I got them on amazon and have proof.

    Came home to teenagers smoking and hotboxing a bedroom and it lingering down the hall i put 2 of those air purifiers 1 in the room and one in my living room and i swear it did nothing at least no room got cleaner air from them i couldnt tell if it even was working and im not the only one who thought that either.

    Purchased a Winix C545 because of its claim on box that “True HEPA Captures 99.97% Particles”. I really don’t think the HEPA filters catch anything that is stated on box!

    I purchased and use the Winix model C610 4 stage true hepa air purifier with WiFi on Oct 3rd, 2025. I wonder if this one does not meet hepatitis standards as well.
