wrongful death, funeralA Kentucky woman recently filed a mesothelioma wrongful death lawsuit after her husband died, alleging his cancer was caused by exposure to asbestos.

The mesothelioma wrongful death lawsuit was filed by plaintiff Brenda H. on behalf of her late husband, Phillip. According to the lawsuit, Phillip was exposed to asbestos and asbestos products while working at two separate TVA plants in the 1970s.

During his work, Brenda says, Phillip was surrounded by and worked with asbestos and asbestos-containing materials, which led him to inhale dangerous asbestos fibers. The lawsuit alleges that General Electric was the manufacturer of these asbestos products, ultimately leading to Phillip’s exposure, diagnosis with mesothelioma, and eventual death.

According to the mesothelioma wrongful death lawsuit, General Electric had a responsibility to “use and exercise reasonable and due care” in the manufacture and production of its asbestos products. It became known that asbestos exposure had serious risks, but the company allegedly did not take the proper precautions in protecting against the dangers of these products.

The mesothelioma wrongful death lawsuit was filed by Phillip’s widow on Feb. 21, 2018, in Massachusetts. The lawsuit was filed on multiple counts, including negligence, breach of express and implied warranties, wrongful death, and loss of consortium.

The Basics of Asbestos Mesothelioma Cancer

Asbestos is a naturally occurring mineral used for manufacturing purposes such as electrical or building insulation, as well as countless other uses. Asbestos is a known carcinogen, a substance capable of causing cancer. Asbestos is closely linked with the development of mesothelioma cancer.

Mesothelioma is a dangerous form of cancer that unfortunately affects thousands of Americans each and every year.

Mesothelioma attacks the lining around the lungs, a thin layer of tissue known as the mesothelium. Mesothelioma cancer generally takes a long period of time to develop. Because of this, there is usually a delay of several decades between asbestos exposure and mesothelioma cancer diagnosis, as in the case of this shipyard mesothelioma from asbestos exposure.

Studies indicate that the vast majority of mesothelioma cases can be linked with exposure to asbestos. Some patients who develop asbestos mesothelioma cancer may not even have been exposed to asbestos directly, and may instead have been exposed to asbestos fibers secondhand over long periods of time, which allows fibers to build up.
