A new whistleblower lawsuit was filed against Architrave Health LLC, alleging that the company wrongfully terminated its Chief Executive Officer after he pressured the board of directors to admit to committing Medicare fraud.
The Medicare whistleblower lawsuit was filed by Robert D. a resident of Douglas County Oregon. According to the whistleblower lawsuit, Robert was one of the original founders of Architrave Health. The company was created to improve Roseburg citizens access to medical services. This was done by linking Mercy Medical Center to a group of doctors in the private practice sector.
Former CEO Robert D. alleges that he was illegally fired from his position in the company after he asked the Architrave Health’s board of directors to admit to the Centers for Medicare & Medicaid Services that they were committing Medicare fraud by illegally paying doctors extra money for prescribing certain treatments and drugs to Medicare patients.
Robert further claims the defendants were paying Umpqua Medical Group $360,000 a year for consulting services that they were not actually performing. Robert claims that the company was also cutting doctors bonuses if they prescribed Medicare patients certain medications and treatments.
According to the lawsuit, Architrave Health committed Medicare fraud and Robert was fired after he reported $10 million in false Medicare reimbursements and acted as a Medicare whistleblower, just three weeks after Architrave Health submitted a full accounting of their illegal practices.
The Medicare fraud lawsuit also claims that once Robert was fired the company attempted to blacklist him and prevent him from working for other medical organizations in the area. Robert alleges that Architrave Health acted in retaliation against him by threatening local businesses and destroying business opportunities for him through the community. Robert also claims that Architrave Health destroyed his reputation.
Filing a Whistleblower Lawsuit
Whistleblower Medicare fraud lawsuits can be filed by individuals who report fraud and illegal activities committed against the government. Laws are in place to protect whistleblowers from retaliatory actions taken by their employers.
Whistleblowing employees who have been wrongfully terminated by an employer may be able to bring a lawsuit against their past employers. Successful plaintiffs may receive compensation for the damages they have suffered due to their employer’s actions.
Whistleblower lawsuits help hold companies accountable and work to prevent fraud against the government. Whistleblower lawsuits are often brought by plaintiffs on behalf of the government.
In exchange the government will generally share a portion of the recovered damages. The portion of damages recovered may range between 15 and 30 percent if the government decides to join in the lawsuit.
The decision to bring a whistleblower lawsuit should be made only after careful consideration. A legal professional can help a potential plaintiff weigh the facts and circumstances of each individual’s case.
