A new Wells Fargo class action lawsuit claims the company did not provide customers with proper notification about overdraft fees.
Customers are supposed to provide written consent for overdraft fees, but Wells Fargo had employees read an unscripted summary of the fees and then opted in the customers if they gave a verbal affirmation, the Wells Fargo lawsuit claims.
According to the lawsuit, Wells Fargo’s practices violate Federal Reserve regulations; all of the bank’s overdraft fees charged to customers who opted in before May 2022 are therefore illegal, the class action argues.
Wells Fargo class action says company has history of ‘troubling’ overdraft practices
Wells Fargo has a “long and documented history of troubling overdraft practices,” according to the class action.
In 2012, the lawsuit notes, the 9th Circuit Court of Appeals confirmed a $203 million judgment against Wells Fargo over claims the bank misrepresented its overdraft practices. The judgment included an injunction against the bank misrepresenting its process for transactions related to overdraft services, the lawsuit says.
Wells Fargo also makes it virtually impossible for customers to resolve their claims of illegal overdraft practices, the class action says.
The Wells Fargo overdraft rules require complainants to go into an individualized arbitration process, but the company has instead forced complainants into mass arbitration “in which the success or failure of their claims was tied to the claims of thousands of other Wells Fargo accountholders,” the lawsuit says.
The process arbitrator also imposed onerous pleading requirements, which caused the dismissal of many claims and led the plaintiffs to file the class action. The requirements were not in the arbitration rules or law, the lawsuit claims.
Apple Federal Credit Union is accused of unlawfully assessing $29 overdraft fees on debit card transactions authorized on sufficient funds, a class action lawsuit from May 2023 alleges.

Oh my gosh! So i’m not crazy? I have had overdraft fees piled on top of one another, charges that wouldn’t go through until the fees were paid or would go through. The depositing of the money also commented earlier is one of the same things I had experienced. They allow you to go negative, charge you $30, deposit $40, and it’ll take a $10 pending charge and another $30 fee.
It’s a struggle to keep anything in that account. I’ve had over draft fees wracked up with minimal notice as well.

They would return the smaller amounts and charge me 35.00 and pay the larger amount and charge me the 35dolllars My account is hurting

I have definitely been over charged with over draft fees. It’s happened so many times.
Actually they took from me 900 thru zelle they didnt cancel my transaction after five minutes me sending it they never updated the person email or phone number so they said they didnt get the call for cancelation n they took my 900 shm another time I had money on my account but itswanst clear on the account they over draft 20 checks i had to pay allthose workers fees they never gave me an explanation why if i got the money on my account to cover all those checks shm
I have noticed that they conveniently will process a check or a debit transaction making you go negative and charge a $30 fee even though you put a deposit in to cover the amount so you would not be negative. I deposit money first and they do not acknowledge that until after they do the debits for some reason…..gee so they can continually charge me $30 a pop.
My late husband & I both had separate WF accounts & noticed that the bank would deliberately chose which checks to pay in order to cause the most overdrafts instead of by time the check(s) were presented.
