Walmart Rollback price retail fake saleIf you shop at Walmart, you may have been subject to the Walmart Rollback policy. According to one class action lawsuit, Walmart uses “Rollback” sales pricing that deceives their customers.

One California woman filed a Walmart lawsuit over the allegedly deceptive Walmart Rollback policy, claiming that its fake “original” prices deceive shoppers, causing them to purchase things they otherwise might not have.

The plaintiff, Brenna C., claims that under Walmart Rollback policy, the retail giant uses fake sales pricing to increase company profits without having to discount products.

Walmart Rollback Policy

The Walmart class action lawsuit, filed in April, alleges that the Walmart Rollback policy uses “original” prices to mark their items that are, in fact, completely made up. This sales method leads customers to believe that the so-called “sale” prices are hugely discounted.

According to the Walmart lawsuit, the original prices displayed on their products are fabricated, but “prominently displayed directly above the purportedly ‘rolled back’ items, with express references to former ‘was’ prices that never existed and/or did not constitute the prevailing market retail prices.”

This Walmart Rollback policy could allow a store to sell items at the original prices, marking it as the “sale” price, and adding a fake “original” price much higher than it actually was. This leads customer to believe that a product is on sale, and may even purchase an item they would not have purchased had they known it was not on sale.

The complaint notes that “[s]uch pricing comparisons were false and deceptive because the marketed, advertised, warranted, and represented former or ‘was’ price were fabricated and did not represent Wal-Mart’s true former, usual or original retail prices for the purportedly discounted items.”

The plaintiff believes that consumers should be able to expect that the original prices on a product are, in fact, the original prices, and that retailers are being honest with how they display their sales. Sales pricing information often causes customers to make their decision whether or not to purchase a given product.

According to federal and state laws, companies are not allowed to mark their products with false or misleading pricing statements. This particular fake sale lawsuit, filed in California, alleges that state law restricts this specific kind of fake sales pricing allegedly performed through the Walmart Rollback policy. The complaint also cites the Federal Trade Commission regulations over fake sales pricing.

There has already been at least one lawsuit filed over this deceptive Walmart Rollback policy, claiming that this pricing system deceives shoppers into purchasing products based on fake original pricing. According to the California lawsuit, the retail chain uses made up prices to trick customers into thinking they are saving on products when they are actually paying the original retail price.
