A Volkswagen spam phone calls class action lawsuit investigation has been initiated due to reports that Audi and Volkswagen have made automatically-dialed calls to customers without their consent.
Consumers have reported both unwanted phone calls and other targeting tactics by Volkswagen and Audi. Consumers say that Volkswagen spam phone calls were made by a marketing company called Peak Performance.
To conduct these spam phone calls, the advertising company reportedly used an auto-dialing system. These calls allegedly targeted customers and solicited them into purchasing new vehicles or to service their own Audi or Volkswagen vehicle.
In fact, in addition to class action lawsuits over Volkswagen shattering sunroofs and the Volkswagen emissions scandal, a robocall class action lawsuit has already been filed against Volkswagen Group of America. They are being accused of violating the Telephone Consumer Protection Act (TCPA) with these Volkswagen spam phone calls.
Overview: Volkswagen Spam Phone Calls
The TCPA was enacted and passed in 1991 to help protect consumers against harassing telemarketing practices. Prohibited actions as determined by the TCPA include using pre-recorded calls, auto-dialing systems, and artificial voice recordings.
Under the TCPA’s authority, the Federal Communication Commission (FCC) has finessed the act’s requirements as technology has changed. One change that was made prohibited businesses from making telemarketing calls without an established business relationship. Thus, “prior express written consent” is mandatory under the TCPA before any marketing calls can be made.
According to the FCC, TCPA rules to telemarketers require them “(1) to obtain prior express written consent from consumers before robocalling them, (2) to no longer allow telemarketers to use an ‘established business relationship’ to avoid getting consent from consumers when their home phones, and (3) to require telemarketers to provide an automated, interactive ‘opt-out’ mechanism during each robocall so consumers can immediately tell their telemarketer to stop calling.”
The Volkswagen spam phone calls class action lawsuit was first filed in 2017. Plaintiffs report that soon after they had purchased their vehicles, they received an unsolicited marketing call asking them to take in their vehicles in for service. The marketing company that allegedly made the call on behalf of Volkswagen is Peak Performance.
The Volkswagen spam phone calls were allegedly made using an auto-dialing system, according to consumer reports and the pending class action lawsuit. During these calls, Volkswagen encouraged customers to either take in their vehicles to a service center or purchase a new vehicle.
The complaint alleges that Peak Performance says it will be able to “return their lost customers with impressive efficiency.” However, the plaintiffs argue that Peak Performance has been attempting to draw in customers with tactics that ignore federal law.
