Unum Disability Insurance Denial LawsuitA man has filed a lawsuit against Unum Life Insurance Company of America under the Employee Retirement Income Security Act (ERISA) of 1974 after his disability benefits were denied.

Plaintiff Donald F. filed this lawsuit in Florida federal court alleging that Unum engaged in a breach of employee benefits when it neglected to pay for his disability benefits although met the requirements of eligibility.

According to the breach of employee benefits lawsuit, Donald was and is currently disabled based on the definition Unum’s disability insurance policy. He states that Unum has refused to pay all money due to him based on the terms of the disability insurance policy to which he is entitled.

Donald filed this lawsuit alleging breach of employee benefits only after he had exhausted all of his administrative remedies available by working directly with Unum in the appeal process.

“Defendant has failed to comply with its own internal rules, guidelines, protocols, and other similar criteria relied upon in making the adverse determination referenced herein, failing to provide a copy of same to Plaintiff and failing to state that same will be provided upon request in its denial Plaintiff’s appeal as required…” the breach of employee benefits lawsuit states.

Donald has filed three counts in his Unum breach of employee benefits lawsuit. The first is an action to recover plan benefits and the second two actions are to clarify the right to plan benefits. Donald is looking to recover all of the benefits due to him under his plan, plus interest and is seeking attorneys’ fees and costs and any additional relief that the Court deems just and proper.

The Unum Breach of Employee Benefits Lawsuit is Case No. 8:17-cv-04555-CEH-AAS, in the U.S. District Court for the middle District of Florida, Tampa division.

Unum and Breach of Employee Benefits

Unum has had a number of lawsuits filed against it for failing to pay benefits due to eligible individuals. Plaintiffs in these lawsuits allege that Unum engaged in a breach of employee benefits by choosing not to pay individuals who met the eligibility requirements under the terms of their policy.

Unum has been accused of a practice known as bad faith insurance. Basically, this means that the insurance company sets up policies to pay benefits to eligible individuals, but does not follow through on its promise to do so for one reason or another.

Lawsuits against Unum over breach of employee benefits often claim that the company continues to deny benefits even though all deadlines were met, all documentation was submitted, proper determination of medical disability was verified by a doctor and more.

Individuals appeal Unum’s denials of benefits yet continue to receive denials until they no longer have any appeals left, and then they’re forced to take matters into their own hands by filing a lawsuit.
