A man has filed an Unum disability claim lawsuit against Unum Life Insurance Co., one of the largest disability insurance companies in the United States, accusing the company of unfairly denying his long-term disability benefits.
Plaintiff Jason D. filed the Unum disability claim lawsuit in a federal court in Tennessee. The lawsuit was filed on March 13, 2018.
According to the Unum disability claim lawsuit, Jason is a resident of the state of Tennessee. He says that he maintained a long-term disability insurance policy with Unum through his employment at Dell USA LP.
However, on Aug. 9, 2003, he ceased his employment due to a lumbar disc disease, which was “complicated by morbid obesity, ultimately necessitating a lumbar fusion surgery,” the Unum disability claim lawsuit states.
Unum approved his application for benefits, and he began receiving disability benefits until March 21, 2017. They later denied his benefits, he says, claiming that his condition had improved and he could perform his own occupation.
Although Jason attempted to appeal the denial, he says Unum upheld the denial in a letter sent to him dated July 2017.
According to the lawsuit, Jason received the opinion of a new spinal surgeon in April 2017. The physician affirmed that Jason continued to endure pain and that he was unable to “sustain even sedentary exertion, due to back pain and inability to sit for periods greater than 15 minutes at a time.”
Nonetheless, through the opinion of one independent medical examiner (IME) hired by Unum, the IME upheld Jason of being able to perform physical requirements of his occupation.
Filing an Unum Disability Claim Lawsuit
Unum Life Insurance Company of America is a top disability insurance provider in the U.S. and the UK. The company provides both long term and short term disability insurance benefits and covers insurance benefits for more than 33 million people around the world.
The company employs 100,000 employees in the U.S. and is one of the largest and most recognized employee benefits companies in the world.
According to Vault, in 2015, the company had more than doubled its net income to over $867 million. Cash flow from operations, that year, increased to 1.2 billion.
However, a growing number of consumers have filed an Unum disability claim lawsuit against the disability insurance giant alleging them of unfairly denying their long-term disability insurance policies.
Several bad faith insurance claims have been filed against the company. Many of these bad faith claims against the company accuse them of underpaying insurance benefits, possessing unfounded denial of insurance claims, and of having unreasonable delays in the processing of claims.
During a segment on 60 Minutes, a feature highlighted alleged bad faith practices. Adjusters who had worked for Unum were featured on that show stating that they were rewarded for denying consumers’ disability benefits.
Many physicians were also shown claiming that they had been fired for refusing to deny consumers’ disability benefits. Former employees of Unum were also shown describing the “intense” environment of Unum and how much pressure there was to make sure consumer disability claims were being denied.
