Unum Disability Benefits Lawsuit Filed by Texas WomanA Texas woman has filed an Unum disability benefits lawsuit against Unum stating that she paid for disability insurance, but when she became disabled, Unum improperly denied her valid claims.

Plaintiff Amy M., a resident of Texas, has filed an Unum disability benefits lawsuit against Unum Life Insurance of America.  She was employed by TesSolve Services, Inc.

According to her Unum disability benefits lawsuit, Amy was issued an employee benefit plan that is subject to ERISA. ERISA is the Employee Retirement Income Security Act of 1974, a federal law that governs pensions and group sponsored benefits offered by employers.

The Unum disability benefits plan that Amy had offered her long term disability benefits. Her Unum disability benefits lawsuit claims that she suffers from a medical condition which does not permit her to perform the regular duties of her job. Under her long term disability plan, alleges the lawsuit, this condition should be covered.

Accordingly, Unum began paying Amy her disability benefits through July 15, 2017. After this date, Amy says, Unum denied her disability benefits.

Amy says she appealed this Unum disability benefits decision, but Unum decided to uphold its denial. She claims that she has exhausted all administrative options and that she has complied with all requirements of Unum’s administrative procedure.

In her Unum disability benefits lawsuit, Amy alleges that Unum is operating under a conflict of interest as they both determine the validity of the claims and also pay the claims.

Amy is requesting benefits under the Unum disability benefits plan because she says she met all the requirements under the plan. She says she also “has complied with Plaintiff’s obligations to make proof of claim in accordance with the Policy’s requirements.” She is also asking that Unum pay for her attorney’s fees and any other relief deemed appropriate by the court.

Amy is not the only claimant who has allegedly been unfairly denied Unum disability benefits. Many other claimants say that they have been unfairly denied benefits under plans that are rightfully theirs.

Unum is the largest disability insurance company in the United States. It is handles nearly 40 percent of the disability claims in the country and provides insurance to roughly 17 million Americans. It has been accused of denying or terminating legitimate insurance claims in an unfair manner in order to boost its bottom line.

There have been investigations and a class action lawsuit launched regarding the hundreds of thousands of denied or terminated Unum disability benefits claims. Customers and claimants allege that Unum has abused its power and has denied legitimate disability insurance claims in a systematic way.

Unum has also been accused of employing a corporate strategy, as reported in 2002 by 60 Minutes, that methodically denies real claims of those who need disability benefits. According to the television show, Unum rewards adjustors who meet claim-denial quota goals. Additionally, Unum has been accused of firing people who are not on board with denying benefits to those who have been truly injured.

Some former in-house doctors have said that they were asked to falsely say that someone who was truly injured was not disabled for the purpose of denying their Unum disability benefits.
