Trinity Health Employees Accuse Company Unpaid Overtime Compensation in Class Action LawsuitTrinity Health employees have filed an unpaid overtime compensation class action lawsuit accusing the Michigan-based company, and two of its subsidiaries, of systematically not paying enough overtime, violating both state and federal wage laws.

Plaintiff John L. claims that he works as a medical lab technician for Trinity Health, employed by Trinity Health and its two subsidiaries, the Mercy Health System and the Lourdes Health System. He alleges that the company violated the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act by not paying him sufficient overtime hours.

John states that these laws require employers to receive overtime pay for hours worked over 40 hours in a seven day period, and in the case of hospitals and healthcare providers, requires employees to receive overtime pay for hours worked over 80 hours in a fourteen day period. Allegedly, the company failed to adhere to these guidelines not only in his case, but in the case of many employees.

John seeks unpaid overtime pay, prejudgement interest, liquidated damages, and reimbursement for legal fees on behalf of himself and all similarly affected consumers.

According to John, he routinely works at multiple facilities owned by Trinity health within a given fourteen-day period. He claims that he worked 80.25 hours at one hospital in the Mercy Health System, and 16.75 hours at two hospitals in the Lourdes Health System. According to him, he worked these 97 hours in the same 14 day period, and is thereby owed 17 hours of overtime pay. However, he claims that he was only paid .25 hours of overtime pay.

John goes on to argue that Trinity Health and its subsidiaries limited overtime pay to the hours an employee worked in only one health system, as opposed to combining the hours worked in multiple heath systems by one employee. He argues that this is done intentionally and systematically by the company to maximize its profits. He claims that this practice violates federal and state wage laws and short-changes employees on overtime pay that they are due.
