Toxic Lexus/Toyota HVAC Evaporator Class Action Lawsuit

By Mike Holter

Lexus RX 350A federal class action lawsuit claims Lexus and Toyota vehicles produced after 2006 have defective HVAC evaporators whose coating peels off and blows into the cabin as toxic aluminum hydroxide.

According to the Lexus/Toyota HVAC evaporator class action lawsuit, the evaporators are present in the vehicles to stop mold and mildew from forming in the air ventilation system. Due to corrosion, however, the aluminum hydroxide coating in the HVAC evaporators begin to peel of and are emitted into the vehicle’s cabin as a white particulate through the ventilation system.

The Lexus HVAC class action lawsuit says the automakers knew about the alleged defect because they sent out a letter dated March 25, 2010 that stated in part: “Due to unexpected corrosion of HVAC evaporators, some owners of Lexus vehicles may experience aluminum hydroxide emitting from the ventilation system. Aluminum hydroxide is widely used in digestive medicines as antacid. Our understanding is that aluminum is not accumulated in the human body so that aluminum excess intake does not produce any harmful effects on the body.”

The Plaintiffs in the the Lexus defective HVAC class action lawsuit disagree, however, stating the aluminum hydroxide particulates caused extensive damage to their vehicles, as well as respiratory and related medical problems such as dry and sore throats, tightness and dryness of the chest, and chest pain that was exacerbated whenever they were in their vehicle and the air conditioning or heat was used. Had they known about the Lexus HVAC defect, they would not have purchased their vehicle or would have demanded a price reduction, they say.

The defective HVAC evaporator class action lawsuit is brought on behalf of a proposed class of all individuals who purchased or leased a Lexus or Toyota model with the same or similar HVAC evaporator defect from 2006 through the present. It is seeking injunctive relief, compensatory damages, punitive damages and more for Breach of Express and Implied Warranty, Consumer Fraud, Negligent Misrepresentation, Unjust Enrichment and more.

We have a 2004 Toyota Corolla with this same problem. Is this lawsuit still active, and can you tell me if and how I can be added to the class please? Very nice owner of Auto A/C World at 7920 NW 67 Street, Miami, FL 33166, 305-467-8387, quoted $670 to replace the evaporator, expansion valve, and dryer, and clean out. He says this is a common problem with certain models!
