
Texas PFAS lawsuit overview:
- Who: The state of Texas is suing chemical companies 3M, DuPont and Corteva.
- Why: Texas argues 3M, DuPont and Corteva failed to disclose the risks associated with exposure to their products containing per- and polyfluoroalkyl substances (PFAS) while simultaneously falsely, deceptively and misleadingly representing that the products were “safe.”
- Where: The lawsuit was filed in the 18th District Court of Johnson County, Texas
The state of Texas filed a lawsuit against 3M, DuPont and Corteva over claims the chemical companies failed to disclose the health risks and environmental harms associated with their products containing per- and polyfluoroalkyl substances (PFAS).
Texas’ lawsuit also claims that the companies for decades made false, deceptive and misleading claims that their products were safe, while concealing the risks of PFAS from both the state and consumers.
“But Defendants knew for much of this time, during which they profited immensely from the sale of their products, that PFAS pose risks to people’s health and impact the environment,” the PFAS lawsuit says.
Human exposure to PFAS may be associated with a decreased vaccine response and diseases such as cancer, while exposure to the environment causes PFAS to contaminate drinking water and other natural resources and accumulate in fish, game, other animal and plant life and in the blood of humans, according to the lawsuit.
3M, DuPont, Corteva knew of risks associated with exposure to PFAS, suit says
The state argues 3M, DuPont and Corteva have known since as early as the 1970s that their PFAS was “building up in the blood of most Americans.”
The lawsuit further claims the chemical companies knew of the alleged risks associated with PFAS exposure and that they could not contain the existence of the so-called forever chemicals in their consumer products.
“Nonetheless, Defendants concealed these substantial risks from consumers and the State, and for decades, they even affirmatively claimed their products were ‘safe,’” the PFAS lawsuit says.
Texas argues 3M, DuPont and Corteva are violating its Deceptive Trade Practices Act (DTPA). The state asked the court to stop the companies from selling products with PFAS or advertising that they are safe, in addition to civil penalties of $10,000 per violation of the DTPA.
A group of Nantucket, Massachusetts residents filed a class action lawsuit against 3M and multiple other chemical manufacturers in October over claims they contaminated the island and its water supplies with PFAS.
