Plaintiff Samuel T. has initiated a lawsuit against the driver of a truck as well as his employer company after allegedly suffering severe injuries in a Swift trucking accident.
The lawsuit says that the employer, Swift, is responsible, in addition to the individual driver, for the injuries sustained by the plaintiff.
The Swift trucking accident lawsuit says that the plaintiff was the operator of a 1997 International Harvester truck and the defendant individual driver was the operator of a 2012 Kenworth truck. The lawsuit says that in the Swift trucking accident, Swift remained the registered owners of a 2017 Freightliner and a 2012 Wabash trailer that were involved in the related accident.
The Swift trucking accident lawsuit says that the plaintiff, working as a truck driver for Coyote Transportation, was forced to suffer injuries as a result of the defendant who was a truck driver for Swift transportation. In October 2016, according to the lawsuit, the Swift vehicle was traveling northbound on Highway 95 through Idaho while hauling a large load.
The Swift driver allegedly applied the brakes of his vehicle in an effort to avoid hitting a deer that had run out in front of the truck. The plaintiff says the load that was being carried by the driver shifted forward at that point in time, causing the load to break through the bulkhead of the trailer.
One of the items inside, an ingot, fell out of the trailer and ultimately disconnected the air lines running through the trailer brakes, the plaintiff claims. This allegedly caused the trailer brakes to lock up and forced the defendant’s vehicle to come to a stop in the northbound lane of travel while also putting one of the 2,000-pound lead ingots in the middle of the southbound lane.
At that time, the plaintiff says he was traveling southbound in a truck that was carrying an SUV and two pickup trucks, when he struck the lead ingot that had fallen into the road’s southbound lane.
Falling debris can cause serious injuries to drivers on the road because other motorists might not have enough time to avoid striking the object. Furthermore, cars behind the one that hits the item initially may not be aware of the item in the road, meaning that a pileup can occur quickly.
The Swift truck accident involved being pushed throughout the road and a vehicle catching on fire, a situation that the plaintiff claims is directly due to the negligence of the defendants. This negligence allegedly caused significant damage to the front of the plaintiff’s truck, and he says that he sustained severe bodily injuries as a result, in addition to emotional and physical pain and suffering, psychological trauma, and other general damages.
As with this Swift trucking accident lawsuit, injured victims might have the opportunity to pursue a lawsuit against responsible parties including an employer who negligently hired or supervised the employee who allegedly caused the accident.
