Drivers who utilize SunPass for toll fees in Florida have reported receiving unexpected and erroneous charges for a SunPass toll violation they never actually incurred. A SunPass toll violation can occur by having a pass used by an unauthorized vehicle or not maintaining a proper balance in the account.

In many cities, drivers pay tolls to drive on certain highways. Although some highways still use toll booths to assess fees, many highways use modern technology to collect fees automatically.

Many companies, such as SunPass, offer a cashless system that allows drivers to pay their toll fees automatically without stopping at a booth. A transponder is typically attached to the vehicle’s windshield and antennas record information in order to charge the correct account. If a vehicle is not linked to an account, a camera takes a picture of the license plate and sends the registered owner a bill for the toll violation.

A man recently encountered trouble with toll fees when he began receiving toll charges for a vehicle that was not his. According to WFTV, John W. allegedly was charged repeated fees for a car using his temporary tag information, although he had previously destroyed his temporary tag after receiving his permanent tag.

For weeks, John says he attempted to work with customer service representatives, but they told him he needed to file a police report. When he tried to file a police report, he was told he could not since the tag was likely a forgery, not stolen. After multiple communications with the company and state transportation department, John finally had the charges dismissed.

Although John’s charges were eventually dismissed, not all drivers who receive fees for a SunPass toll violation are successful in disputing the claim. In some cases, additional charges related to a SunPass toll violation can accrue thousands of dollars without the consumer’s knowledge. Unpaid fees and penalties can be sent to collections or lead to other consequences such as a registration hold on a vehicle.

Like John, some consumers have reported being charged a SunPass toll violation for a car that is not theirs. Other consumers report being charges fees much higher than what was posted. For example, New York residents have reported a $100 EZPass toll violation for a tunnel or bridge when the typical fee is less than $10.

A SunPass toll violation is filed without notice and written notice of the penalties is not sent until weeks after the initial violation. In the meantime, drivers continue to unknowingly accrue further SunPass toll violation fees. Some drivers have reported accruing thousands of dollars in fees.

If you or a loved one were hit with a penalty from a SunPass toll violation, you may be eligible to participate in a free class action lawsuit investigation. A lawsuit against an offending toll company could help recover compensation for excessive fees.

They really make it impossible for you to paid off any debt with them. I just called them to pay $250 and they said that I need to call Alliance1 (Collections) to pay, once you paid to collections, collections told me that I need to wait 1 week until they clear it in the system so I can call again Sun Pass for them to conect my Sun Pass account with my bank account. The problem is that meanwhile Collection clear that in Sun Pass system I as any other mortal working person that lives in Miami need to pass through tolls to get to work, therefore, fees will be accrued again. This is a never ending loop. The system is made to trap you. Please let me know how I can join that Class Lawsuit against them.

I have paid double for I don’t know how long. I just got a new car and put an epass on it and signed up for toll by plate also. After the first week I recieved a too enforcement invoice from Sunpass. It’s out of control corruption.

In February 2022, I called Sunpass to file a complaint disputing hundreds of charges on my account. Issues include:
    – double charges — tag and transponder — for two different vehicles
    – charges for tolls where I have never been
    – charges in Miami and Orlando at the same time on the same day.

The Sunpass rep she could not explain so many erroneous charges to the tune of thousands of dollars. She put me on hold over and over again to speak to supervisors who also had no answers. She literally could not explain the charges yet refused to credit my account. I requested a Full Audit of my account. I have not heard from anyone at Sunpass by phone, email or mail about this audit since then. Is there a class action lawsuit against Sunpass?
