A recent tractor trailer lawsuit has been filed against trucking company Statewide Carriers LLC, alleging one of their drivers had acted negligently and caused the claimant to sustain serious and permanent injury.

The tractor trailer lawsuit is also naming one of the company’s drivers as a defendant in the lawsuit, stating his negligent actions had directly caused the plaintiff’s injuries.

Virginia plaintiff Troy W. is naming Statewide Carriers LLC and driver Giyeon Won as defendants in his tractor trailer lawsuit, which is seeking compensation for medical damages related to his injuries. According to the tractor trailer lawsuit, Troy had been severely and permanently injured when his tractor trailer have been struck by another tractor owned by Statewide and operated by Won.

Troy is filing this claim as a personal injury lawsuit, a claim that a person can bring after they sustain damaged from the other party that is supposedly legally responsible for that harm. Personal injury lawsuits like this one seek compensatory and punitive damages, with the former relating to any actual injuries the claimant sustained from the other party.

Troy alleges he has been unable to work since sustaining his injuries. According to his tractor trailer lawsuit, the incident occurred on April 11, 2016 at a Walgreens Distribution Center.

Troy says he was in his trailer at the time in the loading dock, with Won arriving at the same distribution center running an errand for Statewide. Won had reportedly positioned to his vehicle to reverse into the loading bay, who had also unlocked his two rear doors of his trailer.

Upon backing into the loading dock, Gon’s rear doors allegedly flew open and struck Troy’s trailer. This reportedly caused Troy to suffer a six-foot fall, landing on his left side onto the pavement.

Troy’s tractor trailer lawsuit alleges he sustained damages to his left shoulder, hip, knee, lumbar, and nervous system, and permanent orthopedic and neurological injuries. Due to these injuries, Troy alleges that he can no longer work in his job as a trucker because he is now unable to sit for longer period of times.

At all times relevant, Troy alleges he followed all safety protocols of his work and acted within a reasonable manner. The lawsuit claims that he would not have been injured if not for Gon’s actions. Troy is seeking all relevant damages for his medical injuries, along with multiple counts of negligence.

This Tractor Trailer Lawsuit is Case No. 5:18-cv-00983-EGS, in the U.S. District Court of Eastern Pennsylvania.
