Sleep Number class action lawsuit overview:

Sleep Number uses false and deceptive pricing practices with the sale of its beds, a new class action lawsuit alleges.

Plaintiffs Gerardo Prieto and Athena Lonich filed the class action complaint against Sleep Number Corp. on Jan. 14 in a California federal court, alleging the company violates state and federal consumer laws.

The two claim in their lawsuit that Sleep Number falsely advertises inflated comparison reference prices in its stores and on its website to deceive customers. 

They allege this deceptive practice misleads customers into believing they are getting a deal, causing them to spend more money than they otherwise would have.

Sleep Number uses fake reference prices to lure customers, class action says

The lawsuit alleges that Sleep Number relies on deceiving customers with fake sales as a business model. 

On a typical day, the company prominently displays sales where beds are marked down from a higher reference price, which is crossed out next to the sale price, the plaintiffs say. These reference prices are almost always falsely inflated, as Sleep Number rarely, if ever, sells the beds at those prices. The only purpose of the reference prices is to mislead customers into thinking they are getting a substantial discount, the lawsuit claims.

The plaintiffs claim they fell victim to these deceptive pricing practices when they purchased a Sleep Number i8 bed smart bed in July 2023. 

They say they were misled into believing they were getting a discount based on a false reference price of $4,599, when in reality, the bed had not been sold at that price for a substantial period of time.

Their lawsuit seeks to represent a class of all California consumers who purchased one or more Sleep Number beds during the relevant time at a stated discount from a higher reference price and who have not received a refund or credit for their purchase(s).

The plaintiffs are suing for violations of California’s unfair competition law, false advertising law and consumer legal remedies act, as well as fraud. 

They seek certification of the class action, damages, fees, costs and a jury trial, as well as an injunction stopping Sleep Number from continuing the alleged deceptive practices.

In recent times, numerous retailers have been hit by similar allegations of using fake reference prices.

    I bought a Sleep Number 08/2025. It was delivered 11/18/2025. It has never worked correctly and confirmed by their technician to be a defect in the product. For two months, they tried to tell us nothing was wrong with the bed. We called corporate and made visits to the store weekly since that time. It is now January 30, 2026 and we have lost all faith serious breach of trust, and with Sleep Number Corporate’s failure to provide timely, reasonable, and cooperative communication, we no longer have confidence in the company’s ability or willingness to effectively address their defective merchandise, nor resolve any future issues that may arise. They finally said they would send out a new smart frame, but there is no guarantee that it will work. We asked for a full refund, but were told that all sales are final, even with a defective product. We sent a final demand letter on 01/30/26 and are waiting to hear their response.
