Sleep Number uses false and deceptive pricing practices with the sale of its beds, a new class action lawsuit alleges.
Plaintiffs Gerardo Prieto and Athena Lonich filed the class action complaint against Sleep Number Corp. on Jan. 14 in a California federal court, alleging the company violates state and federal consumer laws.
The two claim in their lawsuit that Sleep Number falsely advertises inflated comparison reference prices in its stores and on its website to deceive customers.
They allege this deceptive practice misleads customers into believing they are getting a deal, causing them to spend more money than they otherwise would have.
Sleep Number uses fake reference prices to lure customers, class action says
The lawsuit alleges that Sleep Number relies on deceiving customers with fake sales as a business model.
On a typical day, the company prominently displays sales where beds are marked down from a higher reference price, which is crossed out next to the sale price, the plaintiffs say. These reference prices are almost always falsely inflated, as Sleep Number rarely, if ever, sells the beds at those prices. The only purpose of the reference prices is to mislead customers into thinking they are getting a substantial discount, the lawsuit claims.
The plaintiffs claim they fell victim to these deceptive pricing practices when they purchased a Sleep Number i8 bed smart bed in July 2023.
They say they were misled into believing they were getting a discount based on a false reference price of $4,599, when in reality, the bed had not been sold at that price for a substantial period of time.
Their lawsuit seeks to represent a class of all California consumers who purchased one or more Sleep Number beds during the relevant time at a stated discount from a higher reference price and who have not received a refund or credit for their purchase(s).
The plaintiffs are suing for violations of California’s unfair competition law, false advertising law and consumer legal remedies act, as well as fraud.
They seek certification of the class action, damages, fees, costs and a jury trial, as well as an injunction stopping Sleep Number from continuing the alleged deceptive practices.
In recent times, numerous retailers have been hit by similar allegations of using fake reference prices.

My husband and I purchased a sleep number bed in 2019. Boy did I get sucked in paid almost $6000 for this bed. Got all these promises it had a 25 year warranty said one guy needed a new foam piece for the mattress and it didn’t cost him anything. I call up to get my mattress covering replaced because the magnets ripped out that hold the mattress in place. Well now I’m getting some crap that its prorated and they’ll cover 60% and my cost was $360.00. The whole reason I bought the bed I thought it would help my back and the main thing was the 25 year warranty. They said nothing about it could be prorated. Don’t get sucked in I thought car dealers were bad.

I had a sleep number bed about 30 years ago before all the hype it was great! I had it for 27 years. I moved and had to sell a lot. 5 years ago I purchased another the split king p6 with head raising and headboard accessories for $7,957.58!!!! I’m so disappointed and disgusted. They pro rate warranty and don’t explain when purchasing so my 5 year old 7995.00 bed needs replacement parts they’re charging 1600.00 plus for parts and charge for technicians??? that says even they know they are selling a bad product. If their product and customer care was as good as the fortune they sell and scam then I could say good things. NOT THE CASE THEY TREATED ME HORRIBLY AND JUST KEPT SAYING NOTHING WE CAN DO WE STAY WITHIN WARRANTY GUIDELINES. And their customer service is horrible!! Everyone supervisor and so called executive customer service was worse they all sound like robots and don’t care one bit about customer satisfaction. They all said same thing we follow warranty and were very rude and disrespectful. I asked to talk to the president or vice president as I think the executive was only a title and couldn’t or wouldn’t do anything and was told she’s the highest level I can talk to. WHAT???? THAT SEEMS SO SKETCHY AND WRONG why won’t they talk to or handle situations especially when a customer is so upset. Like I said never ever have I experienced such bad treatment. She also said everyone is given same answer and has to pay etc if outside warranty. FYI EVERYONE IS NOT THE SAME AND ISSUES ARE NOT THE SAME Each person should be treated with individualism and being thanked for and treated like individuals. I’ve never ever experienced this type of service from any company in my life. And when I told them all the bad comments I saw on yelp, BBB, sleep number reviews , social media and many more I wax told we also have a lot of good ones to. I was stunned, wow is all that comes to mind. I’m disabled with horrible back, neck and hip issues. I was told to lift mattress and bed to trouble shoot. I told them of my disability and can’t do that they said well can you ask someone to help. ? I said no and pretty much they just went back to they follow warranty, in other words “too bad not our problem “.? I have parts falling off underneath bed, mattress crooked and a foot off base and bed is lumpy, making my disability worse. $190.00 for someone to come out to say what’s wrong then was given quote on what it could be that cost is $1664.58 including another technician fee of 190. I agree class action!!! And anything else that exposes this!! They are NOT same company of 25 years ago. I’m so upset with how they treat everyone the same and put us all in one category regardless of situations. All I’m wanting is for their technicians to come fix my bed. They won’t acknowledge any one of my concerns or try fixing it.

Dear Sleep Number Customer Service,
I am writing regarding my recent purchase (Order #[insert order number]), placed on March 10, 2025, with delivery completed on April 19, 2025. After reviewing current promotions, I noticed a significant Presidents’ Day sale that would have reduced my total cost had the timing of delivery and purchase aligned more reasonably.
When I contacted customer service to request a price adjustment or return accommodation, I was denied both. I spoke with a supervisor, who:
• Refused to honor the Presidents’ Day promotional pricing.
• Stated I could only return the bed—not the accessories—and that I would be charged a fee to do so, despite being within the return window.
• Refused to provide any contact information or means of escalation, instead instructing me to simply “call back and speak to someone else.”
This dismissive and evasive approach to customer care is unacceptable for a brand of your reputation. I am not seeking anything unreasonable—I’m simply asking that Sleep Number either:
1. Honor the current promotional pricing for the product I just received,
OR
2. Allow me to return the full order—including accessories—without penalty, given the pricing discrepancy and delivery timeline.
I trusted that Sleep Number would stand by its policies and customer satisfaction commitments. If we cannot resolve this fairly and promptly, I am prepared to escalate this to consumer protection agencies and the Better Business Bureau.
I hope this can be addressed with the level of service your brand promises.

Although I have no experience with Sleep Number, your comment doesn’t make any sense. You said you purchased in March yet you expected them to honor a Presidents’ Day sale which would have been in February. You claimed that you found this discount in April after looking at the “current sales”. So Presidents’ Day wouldn’t have been a current sale? Also why would you expect a company to honor a sale from the past? Although it would be great if businesses worked that way, 99% don’t for good reason.
