Shipyard Asbestos Exposure Lawsuit Claims Employer is ResponsibleA new shipyard asbestos exposure lawsuit has been filed after a man allegedly developed cancer decades following his interaction with the dangerous fibers in his workplace.

The plaintiff in the shipyard asbestos exposure lawsuit, Callen D., says that between 1962 and 1994 while working for the shipbuilders included as defendants in the complaint, regular asbestos exposure occurred.

The plaintiff in the shipyard asbestos exposure lawsuit says that his employer had a responsibility to keep employees aware of dangerous conditions in the workplace, but failed to do so and put him and other works at risk for cancer and asbestos-related conditions.

In the shipyard asbestos exposure lawsuit, the plaintiff says that he worked for Avondale and was regularly exposed to asbestos in the course of his typical work duties. He also says that he brought many of these dangerous fibers into his home on his clothing.

The plaintiff says that up until 1975, he was exposed to asbestos on a daily basis and that this ultimately led to his development or lung cancer. The shipyard asbestos exposure lawsuit alleges that Callen’s medical records show that tissue damage occurred at least beginning in 1975, and that this led to the development of cancer over time.

The lawsuit says that his shipyard asbestos exposure culminated after daily exposure to extremely high levels of these dangerous fibers. He also says that riding to and from work and to work sites led to additional exposure to asbestos fibers when they were present on the clothing of other employees.

The shipyard asbestos exposure lawsuit says that the company made a serious error in failing to warn Callen and other similarly situated employees about the high levels of asbestos present in their working environment. Callen alleges the company, as well as the executive officers, should be held liable for the injuries  he sustained.

The lawsuit was filed on numerous grounds against the employer, including failing to provide respiratory protection, failing to provide showers and clean clothing, failing to warn employees about the dangers of asbestos exposure, and failing to reveal critical medical details to the plaintiff and other workers.

Often, a diagnosis of cancer tied to previous asbestos exposure happens years or even decades after the patient came into contact with asbestos. This is because the fibers often irritate the internal body of the patient over time, manifesting in different medical conditions such as cancer after a long latency period.

It might be some time before a patient even realizes that their diagnosis of cancer is due to shipyard asbestos exposure that happened decades prior, but this might allow a victim to file a lawsuit sooner rather than later.
