Senior in Home Care Services Class Action Lawsuit Filed by Former EmployeeA senior in home care services class action lawsuit has been recently filed by a former employee of Home Helpers, alleging that the company violated the Fair Labor Standards Act (FSLA). The lawsuit also claims violations of the North Carolina Wage and Hour Act.

The senior in home care services class action lawsuit is currently seeking individuals who may have either been currently working for Home Helpers or have worked for the company or one of its subsidiaries within the past three years.

According to the senior in home care services class action lawsuit, allegations against Home Helpers include the following:

  • Failure to pay minimum wage
  • Failure to pay overtime pay
  • Failure to provide undisturbed sleep of at least five hours
  • Requiring off-the-clock work by employees
  • Plaintiff retaliation for complaining of wage and hour violations

The company contracts directly with individuals and family members of the elderly to provide these services.

However, there is a culture of non-compliance through violations of the FLSA among its home care employees, according to the wage and hour lawsuit. The culture of non-compliance was made evident through a 2015 study conducted by the National Employment Law Project, that discovered FLSA and wage and hour violations. The study reports that there are frequent FLSA violations including employees required to work off-the-clock, wage violations, and the company fails to provide overtime pay.

According to the senior in home care services class action lawsuit, one employee worked six 24-hour shifts and was paid only a flat rate of $170 per day.

Although employees regularely worked in excess of the federally mandated 40 hours per week, Home Helpers refused to pay them any overtime pay. This is a clear violation of FLSA regulations and North Carolina Wage and Hour Act, the senior in home care services and class action lawsuit states.

State and federal law require that employees are treated fairly. There can be a number of wage and hour violations in addition to the failure to pay overtime.
