Segway class action lawsuits overview:
- Who: A pair of class action lawsuits were recently filed against Segway Inc.
- Why: The complaints each argue Segway sold “deceptively dangerous” electric scooters and tried to resolve the issue with an “inadequate” recall effort.
- Where: The class action lawsuits were filed in Delaware federal court.
Segway sold “deceptively dangerous” electric scooters and tried to alleviate the problem with an inadequate recall effort, a pair of newly filed class action lawsuits allege.
The class action lawsuits separately claim Segway sold roughly 220,000 Segway Ninebot Max G30P and Max G30LP KickScooters that had to be recalled in March over concerns they posed a fall hazard.
The complaints argue “scores” of consumers were injured by a defect that caused the scooters to “effectively collapse on themselves” and launch riders off the devices in the event they were going roughly 20 miles per hour.
“Like Plaintiffs, customers have routinely ended up in emergency rooms around the country,” one of the Segway class actions, filed by Aaron John Sabu and Christopher Holmes, says.
Sabu and Holmes want to represent a nationwide class, multi-state consumer protection class and California and New York subclasses of consumers who bought one of the recalled Segway scooters.
Meanwhile, plaintiff Barton Cicero wants to represent a nationwide class, multi-state consumer protection class, multi-state implied warranty class and Massachusetts subclass of consumers who bought one of the recalled Segway scooters.
Segway allegedly refuses to refund consumers affected by recall
The class action lawsuits argue Segway’s recall for the electric scooters involves contacting the company to receive a “maintenance kit” that involves following a “complex and confusing” set of instructions to “purportedly fix the issue.”
“Consumers did not bargain for an expensive e-scooter that could collapse, causing users to be flung from the e-scooter at full speed without notice unless they personally performed routine maintenance that they are not competent to perform and that is unlikely to fix the defect,” both Segway class actions state.
The complaints further claim Segway denies any requests for refunds, returns or replacements, leaving consumers only with the option to attempt to fix the scooters themselves by way of the maintenance kits.
Cicero claims Segway is in violation of Massachusetts law and guilty of unjust enrichment, fraud by omission and intentional misrepresentation.
Meanwhile, Sabu and Holmes claim Segway is guilty of unjust enrichment, fraud by omission and intentional misrepresentation and in violation of consumer protection laws in New York and California.
The plaintiffs all demand a jury trial and request declaratory and injunctive relief and an award of actual, compensatory, statutory, nominal and/or punitive damages for themselves and all class members.
In 2024, DGL Group and Razor issued a separate recall involving thousands of electric scooters over concerns some of the devices contained defects that caused injuries to dozens of consumers.

Woke up in the ER on Saturday not knowing where I was. Ninebot gave me a concussion and scrapes along my face, arm, and leg. The tire popped out from the handlebars and caused me to flip.
I bought a max g30p in 2022, requested a ‘kit’ to solve collapsing problem and still haven’t used it since it came with no instructions!

I was on my Segway doing 18 mph hit a bump and my handle bars collapsed causing me to be launched. To the ground i shattered my elbow lost my job I still can’t straight out my arm
I was riding my Segway ninebot and hit a bump, and where the folding joint on the handlebars is completely came apart. So I fell got some road rash hit my knee and hurt my back from the tuck and roll. I’m older so it takes longer to heal, still in pain.
I use my ninebot to get to and from the buses that I ride I hit a bump and the whole handlebars came off. I had gloves on so I didn’t get road rash on my hands but my elbow did and my back my upper back got hurt and my knee. Add me please. From where the handlebars fold that whole joint came apart on me. I’m older so it’s lots of pain longer to heal also.
