Puritan's Pride fake sale nutritional supplementsA Puritan’s Pride class action lawsuit has been filed in California federal court alleging that the company has engaged in deceptive advertising through its “buy one, get one free” marketing strategy.

Plaintiffs Meg Larson and Diane Cabrera said that although the marketing indicated that customers would receive additional items for free if they purchased one or more products, Puritan’s Pride actually built the cost of the allegedly free items into the marketing, which left consumers not benefiting from any type of actual sale.

Larson gave an example in her Puritan’s Pride class action lawsuit stating that she had made a number of purchases from Puritan’s Pride, including vitamin D3 and garcinia cambogia under a buy one get two free offer. Rather than actually getting the items at a discount, Larson states that she paid a premium price for one item that covered the cost of the other two items that were supposed to be free.

“Defendants engaged in the … systemic and continuous practices of disseminating false, deceptive, and misleading information about the Products via an extensive and comprehensive nationwide marketing campaign, consisting of Internet postings, last emails, targeted emails,” and more, the lawsuit states.

This marketing is “intended to induce unsuspecting consumers, including Plaintiffs and members of the Class, into purchasing millions of dollars worth of Puritan’s Pride branded Products at a premium price,” Larson and Cabrera alleged in their Puritan’s Pride class action lawsuit.

In addition to the deceptive advertising, the plaintiffs state that the company misrepresented that their “buy one, get one free” and “buy one get two free” sales were for a limited time only, but their promotions were in fact enacted in an ongoing basis.

“Defendants conceal that their marketing and advertising campaign promising ‘free’ Products is permanent, and intend to induce consumers to make expedited purchases by falsely representing that they only obtain ‘free’ products if they act quickly,” the Puritan’s Pride class action lawsuit states. “There has been no time in the preceding four years when Defendants were not purportedly giving Products away for ‘free’ under the promotion.”

Puritan’s Pride Class Action Lawsuit Allegations

The Puritan’s Pride class action lawsuit brings forth allegations of violations of California’s Consumer Legal Remedies Act, Unfair Competition Law and False Advertising Law. Larson and Cabrera are seeking injunctive relief as well as economic damages, including restitution and disgorgement of profits. They seek to represent a Class of California consumers who have purchased Puritan’s Pride products during the last four years.
