Jeep class action lawsuitIn a series of oppositions filed May 27, plaintiff lawyers shot down a May 1 motion by Chrysler Group LLC to dismiss a proposed class action lawsuit over allegedly defective window parts used to repair 2002 to 2007 model year Jeep Liberty vehicles, arguing that the automaker’s arguments fall short.

In 2010, plaintiff Michael Wolfington sued Chrysler, alleging that he needed to have his vehicle repaired some 11 times and that “Chrysler never disclosed the defect in the replacement window regulators” to him. In some cases, these fixes could cost more than $400.

Wolfington voluntarily dismissed the Jeep Liberty class action lawsuit in February 2011, and later joined a new class action lawsuit filed by lead plaintiff Steven Doyle in April 2013.

In their opposition to Chrysler’s motion to dismiss the new Jeep Liberty class action lawsuit, the plaintiffs’ lawyers note that the car maker “attempts to evade liability by claiming that it had no duty to disclose the defective nature of its replacement window regulators. Incredibly, Chrysler argues that it had no duty to disclose because Mr. Wolfington ‘knew’ that the replacement window regulators were defective based on his own experience[.]”

Wolfington’s lawyers point to statements he made in the new Jeep Liberty class action lawsuit that had he known of the issue he would have used window parts made by another company. Further, they cast doubt on the statement that due of the frequent necessity of taking his SUV to a mechanic, he should have realized that the vehicles had problems. Yet when he did, he alleges no one told him of the problems.

The same issues come up in a response filed by the lawyers for plaintiff Robin Allen, who also joined Doyle’s complaint. She claims she eventually traded in her 2006 Jeep Liberty after five separate repairs and her father actually screwing some of the windows shut completely. She alleges that her trade-in netted her less money than it otherwise would have because the defective design decreased its value.

Pointing to Maryland precedent governing her claims, Allen’s lawyers argue that it was in fact an economic injury. Further, they note that while she was told that the broken regulators that could leave windows unable to roll up were a known problem for the Jeep Liberty, she had no reason to believe that the replacements would have the same problem.

A hearing on Chrysler’s motion is scheduled for June 23.

    I am the original owner of my 2007 Jeep Liberty. I just paid $875 to have my windows repaired for the 7th time! I called Jeep Customer Care and was given a case # and the OK to take it to the dealer for repairs. While at the dealership, I got a call from the case manager denying the repair because it’s a 2007 and the agent had no authority to authorize the claim!! Jeep needs to do the right thing and stand behind their product!!!

    I am now replacing the third time. Windows just randomly seem to slide down? I went out to my vehicle this morning and the window was down. I can hear regulator but window won’t come up. The last one I had repaired was over 700 dollars at the dealership.

    Have a 2007 jeep liberty, 2 of the windows are held closed with duct tape and a 3rd one just dropped on us today. Only one working window left, and i have a 4 month old baby that i sometimes have no choice but to have in the vehicle. This is ridiculous, and if theres anything i cant to to help move the lawsuit along please contact me.

    3 of My 2004 Jeep Liberty’s windows have been fixed multiple times, the front two are permanently stuck in the up position, my youngest son was driving the Jeep and was pulled over while driving and had to talk out of the sunroof to the cop. This was scary my son is a young black male. My jeep is now Stuck in Wyoming at the Jeep dealership because the rear joints recall.. I live in NC and they Jeep corporation has told me they are not responsible for getting it back to NC although it was not my fault that such a dangerous recall happened to my Jeep!!! Please helo

    I have a 2007 Liberty with only 32K miles on it. I bought it in 2008. I never have passengers in it and rarely lower the windows. I have replaced regulators 4 times now, at over $400 each time. A rear window that had never been lowered suddenly dropped into the door. The driver’s side window has dropped into the door twice. This is absolutely ridiculous. Jeep knows about this problem and it is definitely a manufacturer defect. If there is a class action suit for this, count me in.

    Is there a recall on the 2005-6 Jeep liberties, this is just plain and simple Jeeps problem. I can not beleive all the people that have had problems with these certain years. Is there anything I can do to have Jeep pay for the window regulator?

    I need to be part of this class action suit as well. Windows stuck in open position! Will be over $500.00 to have repaired. Help!

    My front passenger side jusg “popped” today. Now need to look for a repair but these readings don’t seem positive. How do I join this class action?

    I own a 2003 Jeep Liberty. All but one window has been replaced at $500+ a shot.
