pressure cooker explosions burns injuryPlaintiff Cindy F. has filed a lawsuit in Texas federal court against the Home Shopping Network, Inc., due to injuries allegedly suffered while using the defendant’s Elite Platinum 8-Quart Cooker.

According to the power pressure cooker lawsuit, Cindy, a resident of Austin, Texas, purports that she had first received the Maxi-Martic Elite Platinum 8-quart digital cooker in October 2014. She had received it after first ordering it after seeing it air on an advertisement commercial. She had purchased the cooker from the Home Shopping Network.

The product in question is an electric kitchen appliance used to cook food faster than other methods. The product prepares meals inside a sealed pot by boiling liquids inside, producing steam. The steam becomes trapped within to increase the pressure inside the pot. The power pressure cooker lawsuit maintains that the high pressure cooks meals a lot quicker and more efficiently.

Cindy says she first began using the product in May 2015. She allegedly followed all instructions enclosed with the product. She had planned on making beans for her family’s dinner that evening.

According to the power pressure cooker lawsuit, however, “while preparing the beans that day, suddenly and without warning, the lid blew off of the cooker, and the pinto beans burst out of the cooker … resulting in extensive and severe burns to her body.”

She later called Austin Emergency Medical Services and was rushed to the hospital via an ambulance. There, she underwent treatment for her severe burns.

According to the power pressure cooker lawsuit, she continues to endure “severe pain and permanent scarring associated with her burns” to this date.

The power pressure cooker lawsuit further maintains that she had not modified the use of the cooker in any way. Additionally, the counter to which the cooker was placed was leveled, and there was nothing “obstructing or surrounding” the cooker. There was also nothing on the top of the cooker lid.

The power pressure cooker lawsuit states that the defendants failed to “take reasonable care in developing, designing, manufacturing, testing, selling, and/or marketing a product free from defects and safe for consumer use …”

Additionally, the power pressure cooker lawsuit states that the defendants had failed in warning their consumers of potential risks and dangers involved in using the product.

Cindy files the following causes of action against the defendants: Negligence; Strict Liability; Breach of Express Warranty; Breach of Implied Warranty of Merchantability; and Breach of Implied Warranty of Fitness for a Particular Purpose.

Cindy requests a trial by jury. She seeks damages for lost wages, past and future medical expenses, past and future physical pain, and mental anguish.

The Power Pressure Cooker Lawsuit is Case No. 1:17-cv-00498-LY, in the U.S. District Court for the Western District of Texas, Austin Division.
