A Louisiana woman has filed a lawsuit in Louisiana federal court against Unum Life Insurance Company of America for her unfair denial of long-term disability insurance.
According to the fibromyalgia disability claim, plaintiff Anne W. is a resident of the state of Louisiana. She was employed full-time by Baber Donelson, an attorney, until Dec. 31, 2013. According to the fibromyalgia disability claim, she “ceased to work as the result of severe pain and chronic fatigue caused by fibromyalgia.”
Due to her pain, Anne has been unable to work on a regular basis, the fibromyalgia disability claim states.
She further alleges that she “made a claim for benefits under the plan but benefits for her physical disability were denied.” She later submitted an appeal and provided evidence that had proved her physical disability but Unum continued to deny her physical disability benefits.
According to the fibromyalgia disability claim, Anne alleges that all of her “avenues of administrative appeal have now been exhausted.”
The fibromyalgia disability claim states that “the determination by Unum that… [she] is not physically disabled is contrary to the plan, contrary to the evidence, and has no rational support. “
“Unum’s determination is also contrary to the reports of the treating and examining physicians and other medical service providers.”
Denied Fibromyalgia Disability Claim Unum Facts
Unum is one of the largest disability insurance companies in the United States. Reportedly, almost 40 percent of disability insurance policies in the U.S are provided by Unum. There are approximately 17 million Americans being provided disability insurance benefits through Unum.
However, according to television program 60 Minutes which aired a report on Unum in 2002, Unum has “systematically denied disability insurance claims filed by thousands of policyholders to line its pockets.”
Through the television program, former employers of the insurance giant were interviewed. According to the former employees of the company, Unum, “sets a claim-denial quota each month, and rewards claims adjusters who meet the goal by denying injured people the benefits they paid for.”
The 60 Minutes television program also interviewed a former physician who had worked for the company. According to the physician, he was fired after he refused to help the company in denying benefits to injured policyholders.
Accordingly, former physicians who worked in-house for the company have said that they were allegedly told to “review medical records for disability claims and falsely state that a policyholder was not disabled so that UnumProvident could deny disability benefits regardless of the true condition of the insured.”
There have been over 3,000 lawsuits filed over unfair denial of policyholder disability claims.
