
After having her claim for long term disability benefits denied by Unum Life Insurance Company of America, a Pennsylvania plaintiff filed a Unum lawsuit.
The plaintiff, Katherine M., had been employed by Synergy Environmental, Inc., and through the company she was covered by a long-term disability insurance benefits policy from Unum.
Initially, when Katherine suffered from chronic pelvic and back pain and was rendered unable to work, she received her intended benefits. These symptoms, caused by painful bladder syndrome and pelvic floor spasms, entitled the plaintiff to short term disability benefits at first, and then long-term benefits for a period of about two years.
However, Unum eventually denied that the plaintiff’s claim for further long term disability benefits, saying she did not include enough medical evidence in support of her claim.
Though the plaintiff appealed this decision, Unum still refused to reverse the claim denial.
The Unum lawsuit, and others like it, alleges a conflict of interest in Unum acting as both the determiner of claims and the payer of claims, given that this could potentially offer Unum and other insurance providers the power to unfairly deny legitimate insurance claims.
The plaintiff filed this Unum lawsuit in the hope that it would result in the reversal of Unum’s claim denial, and that she would be granted the benefits previously denied to her.
