A new class action lawsuit alleges Papa John’s fails to make its website accessible to blind and visually impaired consumers. 

Plaintiff Henry Tucker’s class action lawsuit claims Papa John’s is denying blind and visually impaired consumers equal access to its website in violation of the Americans with Disabilities Act (ADA).

Tucker, who is legally blind, argues Papa John’s website contains multiple access barriers for blind or visually impaired individuals, including a lack of alternative text, empty links that contain no text and redundant links.

These access barriers that Tucker allegedly encountered have caused a denial of his full and equal access multiple times in the past, and now deter him from visiting the Papa John’s website on a regular basis, the Papa John’s class action says. 

Tucker wants to represent a nationwide class of legally blind individuals who attempted to access the Papa John’s website but were denied access to the equal enjoyment of goods and services offered by the website during the relevant statutory period.

Papa John’s website incompatible with screen readers, class action argues

Tucker argues the website for Papa John’s is not compatible with computer screen reader programs, meaning blind and visually impaired consumers can’t benefit from its online goods, content and services.

“Due to the inaccessibility of Defendant’s Website, blind and visually-impaired consumers such as Plaintiff, who need screen-readers, cannot fully and equally use or enjoy the goods, and services Defendant offers to the public on its Website,” the Papa John’s class action argues. 

Tucker claims Papa John’s is guilty of violating the ADA, New York State Human Rights Law and New York City Human Rights Law. He is seeking a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for himself and all class members.

A consumer filed a separate class action lawsuit against Papa John’s last year over claims the company repeatedly sent telemarketing text messages to individuals who had attempted to opt out of receiving them.

    I guess every restaurant app will be getting sued. This is why prices are so high. Someone is always suing someone.

    I have not ordered anything from them in a while because even with glasses I have a hard time seeing their menu.
