Maurices website class action lawsuit overview:

The website for women’s clothing retail chain Maurices is in violation of the Americans with Disabilities Act (ADA) by not being fully and equally accessible to people who are blind or who have low vision, a new class action lawsuit alleges. 

Plaintiff Julie Dalton’s class action lawsuit claims the Maurices website contains digital barriers to screen-reading software individuals who are blind or visually impaired use to access the internet. 

Dalton, who is legally blind, says the digital barriers deny individuals who are blind or visually impaired with full and equal access to “important website content” that is made available to its sighted website users. 

“Defendant’s policies regarding the maintenance and operation of its Website fail to ensure its Website is fully accessible to, and independently usable by, individuals with vision-related disabilities,” the Maurices website class action states. 

Dalton wants to represent a nationwide class of individuals who are blind or have a low vision disability and who use screen reader auxiliary aids to navigate digital online content and who have accessed, attempted to access or may attempt to access Maurices’ website. 

Maurices website fails to alert screen readers to pop-up window content, class action claims

The Maurices class action claims digital barriers on Maurices’ website include insufficient screen-reader accessible text, inadequate descriptions for certain links and buttons, a failure to alert screen readers to pop-up window content and an illogical tab and focus order. 

“When digital content is properly formatted, it is universally accessible to everyone. When it’s not, the content provider fails to communicate with individuals with a visual disability effectively,” the class action states. 

In addition to allegedly violating the ADA, Dalton claims Maurices is violating the Minnesota Human Rights Act. She demands a jury trial and requests declaratory and injunctive relief and an award of actual, statutory, nominal and other damages for herself and all class members. 

A consumer filed a similar class action lawsuit against Puma North America in November 2023 over claims the apparel company failed to make its website fully accessible to and independently usable by individuals who are blind or visually impaired.
