P.C. Richard & Son, a well-known New York based appliance chain, is under fire recently as some claim the company willfully violated FACTA.
The company opened its doors in 1909 as a family-owned hardware store in Brooklyn, N.Y. The owner, Peter Christian Richard eventually employed his son, Alfred Richard.
Throughout the 20th century and into the 21st century, P.C. Richard & Son has made a name for itself throughout the Northeast as a leading seller of large and small appliances.
However, it has found itself the target of a recent lawsuit regarding the violation of FACTA.
P.C. Richard & Son FACTA Lawsuit
A P.C. Richard & Son FACTA lawsuit claims that a customer was given a receipt with the debit card expiration date printed on it. This is in violation of the Fair and Accurate Credit Transactions Act (FACTA).
This lawsuit is a putative class action lawsuit against the appliance chain and seeks to represent others who have been in similar situations.
The lead plaintiff in this P.C. Richard & Son FACTA lawsuit claims that the company’s FACTA violation were not oversights, but in fact were a way to avoid the extra expense and time it would take to update the electronic receipt printing equipment.
According to this P.C. Richard & Son FACTA lawsuit, the company willfully and intentionally overlooked the legal requirements that applied to the devices that print receipts.
Guarding Yourself Against Identity Theft
With the widespread and constant use of debit and credit cards, consumers must be vigilant that their financial information is not compromised. Even though FACTA offers protection, consumers must be responsible for the safety of their own financial information.
To stay safe,
- Check all transactions often either online or through statements
- Destroy all receipts once you’ve reconciled transactions
- Carry credit and debit cards separately in case someone steals your purse or wallet
- Contact your card issuer if you will be traveling
- Make sure to draw a line through any blank “tip” spaces above the total
- Carry only the card you need for a certain transaction
- Contact your card issuer if your address has changed
- Make sure you get your credit card back after a transaction
- Do not give your account number over the phone
- Immediately report any lost, stolen or comprised cards to the credit card company
How Do I Know if FACTA Has Been Violated?
It is important that consumers check their receipts regularly to make sure stores are protecting vital financial information.
There are two major ways that merchants can violate FACTA:
- Including any portion of the expiration date on the customer receipt.
- Including any numbers other than the last 5 digits of your credit card or debit card number on the customer receipt.
If you have received a receipt with either type of violation from P.C. Richard & Son, you may be eligible to join a free FACTA debit/credit card receipt class action lawsuit investigation against merchants who don’t take appropriate measures to protect your financial information.
