Conagra Brands markets one of its microwave popcorn products as containing only real ingredients when the product contains synthetic ingredients, a new class action lawsuit alleges.
Plaintiff Eloise Jackson-Dorsey filed the class action lawsuit against Conagra Brands Inc Oct. 24 in an Illinois federal court, alleging violations of state and federal consumer laws.ย
According to the lawsuit, Conagra makes and sells microwave popcorn under the Orville Redenbacher brand represented as โNaturalsโ and containing โOnly Real Ingredients.โ
Despite the marketing, the representations are false and misleading because the ingredients on the back panel list โmixed tocopherols,โ a non-natural ingredient, the lawsuit alleges.
Orville Redenbacher Naturals contain synthetic ingredients, class action alleges
Mixed tocopherols are a class of chemical compounds used as chemical preservatives and recognized as synthetic by federal and identical state regulation, Jackson-Dorsey says.
โThe statement of โnaturalsโ is misleading because consumers do not expect the Product to contain non-natural ingredients like mixed tocopherols,โ she says.
Jackson-Dorsey says consumers are willing to pay more for natural products.ย
As a result of the false and misleading representations and omissions, the product is sold at a premium price of $2.99 for 19.74 oz, excluding tax and sales, higher than similar products that do not use allegedly misleading advertising
Jackson-Dorsey is looking to represent a class of Illinois consumers who bought the popcorn, plus a consumer fraud multi-state class of consumers from North Dakota, North Carolina, Kentucky, Utah, Kansas, Idaho, Alaska, Virginia, West Virginia, and Wyoming.
She is suing for breach of warranty, fraud, unjust enrichment and violation of state consumer laws. Jackson-Dorsey is seeking certification of the class action, an injunction, damages, fees, costs and a jury trial.ย
In September, Conagra Brands was hit with a class action lawsuit alleging its Log Cabin pancake mix is falsely advertised as natural and a good source of fiber.

The price did go up, just false advertisement. Letโs be true full and let the consumers have a choice in choosing, not tricked.
