Grace Management Inc. and Vintage Park at Lenexa LLC face a recent nursing home neglect lawsuit filed by a woman on behalf of her father who passed following alleged negligent acts by the defendant.

Plaintiff Jennifer D. filed the nursing home neglect lawsuit in Kansas federal court. The lawsuit was filed on June 21, 2018.

According to the nursing home neglect lawsuit, Jennifer is the surviving daughter of her father, Charles M., and alleges wrongful death due to actions committed against him. Jennifer says Charles was a resident of Vintage Park at Lenexa between Jan. 25, 2016 and Jan. 7, 2017.

However, according to the nursing home neglect lawsuit, Charles was left with inadequate supervision and assistance leaving him at risk for falls and accidents.

It was on Jan. 6, 2017 that he was left “unattended and allowed to fall, which caused injury to, among other areas, the decedent’s femur.” Vintage Park allegedly failed to provide him with “adequate supervision and assistance at Vintage Park to monitor him for risk of accidents and failed to implement procedures to prevent falls.”

Charles was hospitalized at Shawnee Mission Medical Center between Jan. 7, 2017 and Jan. 12, 2017, the complaint says. It was there that he underwent surgery for his fractured femur.

Although later transferred to Rehabilitation Hospital of Overland Park, he was transferred back to Shawnee where he died on Jan. 24, 2017, allegedly due to complications from his surgery.

According to the lawsuit, “[t]he injuries the decedent suffered as a result of the January 6, 2017 fall would have prevented if Defendants had developed and implemented a care plan with appropriate interventions and provided the decedent with proper supervision and assistance (or transferred him to a facility which could provide such care).”

The nursing home neglect lawsuit was filed on multiple counts including negligence and negligence per se.

Jennifer demands a trial by jury.

The Nursing Home Neglect Lawsuit is Case No. 2:18-cv-02335-JWL-KGG, in the U.S. District Court for the District of Kansas, in Kansas City.

In general, nursing home neglect lawsuits are filed individually by each plaintiff and are not class actions.
