A California woman’s New York Life disability insurance lawsuit alleges that NYL and Unum failed to honor disability benefits due under the policy.
The plaintiff who filed this New York Life disability insurance lawsuit, Ella R., was covered by New York Life disability insurance that she had purchased on October 15, 1993.
Ella stopped working as an office administrator for a medical clinic in February 2008 due to a disability. This disability involved a degenerative disc disease that prevented her from performing her job.
After consulting a doctor, in fact, the plaintiff actually found that she had also suffered from a meniscal tear, patellar tendonitis, and carpal tunnel syndrome.
Ella R. filed for total disability under the terms of her Unum policy on March 1, 2009.
At first, the plaintiff was granted her total disability benefits that would cover the period between April 29, 2008 and January 29, 2009.
Ella spent the next several years undergoing tests and exchanging medical documentation with Unum regarding her disability. Unum even referred the plaintiff’s disability claim to the Special Investigation Unit (SUI) over suspected fraud in June 2012.
The plaintiff provided documentation of her disabilities, referring Unum to the medical professionals who had diagnosed her or treated her, and continued to request her disability insurance.
Eventually, on May 27, 2015, Unum determined to uphold its decision to deny the plaintiff’s total disability benefits insurance claim.
Ella R. had exhausted all administrative means over the course of several years, but still had one path forward: filing a New York Life disability insurance lawsuit.
The New York Life disability insurance lawsuit was filed on two counts: breach of contract and breach of the covenant of good faith and fair dealing.
