Another Unum lawsuit was filed against the disability insurance provider accusing the company of bad faith insurance denial. Plaintiff Gregory B. is one of many plaintiffs to claim that Unum Life Insurance Company of America wrongfully denies Unum disability benefits despite the adequate evidence provided by the plaintiffs.
Background on Unum Bad Faith Insurance Lawsuit
Gregory filed for long-term disability benefits through his Unum insurance. However, Unum did not give him the money the plaintiff believed he rightly deserved according to his disability insurance policy. He filed the Unum lawsuit in order to win compensation for all of unpaid disability benefits in addition to attorney fees and other costs.
The Unum lawsuit claims that Gregory has been unable to work from April 22, 2013, to present. “He is not able to perform the essential duties of any occupation because of symptoms, physical limitations, cognitive limitations, and medication side effects related to and as a consequence of his diagnosed medical conditions,” according to the Unum lawsuit.
The Unum lawsuit listed his disabilities to include: degenerative disc disease, dizziness, cognitive impairments, balance limitations, headaches, photophobia, fatigue, nausea, apnea, and arthritis.
Gregory claims he filed for Unum disability benefits as he was supposed to, but was denied due to Unum’s alleged practice of bad faith insurance denials. The plaintiff appealed, “every unfavorable determination by Unum,” but these appeals failed to cause Unum to pay Gregory his allegedly deserved disability benefits.
Allegations against Unum include a claim that Unum, “failed to provide a full and fair review, made an unfavorable decision with no substantial evidence, mischaracterized the job demands of [the plaintiff], failed to show proper consideration of the medical records as a whole–including failing to consider each severe impairment, and Unum abused its discretion,” according to Gregory’s bad faith insurance lawsuit.
Unum has allegedly wrongfully denied countless policy holders their disability benefits. Numerous Unum lawsuits claim the disability benefits provider was both responsible for determining if the plaintiff was in fact disabled as well as paying for that disability insurance. This creates a conflict of interest, as it is in Unum’s best interest to find the patient not disabled. Many patients even had a second physician evaluate them and find them obviously disabled, and yet their Unum disability benefits claims are still denied.
Unum Lawsuits
Many patients have filed bad faith insurance lawsuits against Unum for failing to grant them what is rightfully theirs. Plaintiffs may win compensation for the accrued unpaid disability benefits as well as for legal fees and pain and suffering.
Unum is one of the largest disability benefits providers in the country and has allegedly wrongfully denied thousands of Unum disability benefits policy holders with the potential to wrongfully deny more in the future.
