Lead plaintiff Alex Isaac filed a class action lawsuit against the home furnishings company as well as Bargain Discount Markets Inc. alleging that DuraBlend is marketed as a durable leather product; however, DuraBlend furniture is not durable and is prone to peeling and disintegrating.

“Ashley and BD marketed DuraBlend upholstery as durable blended leather,” alleges the Ashley Furniture class action lawsuit. “Indeed, its name is a combination of the words durable and blended, supporting a reasonable consumer’s belief that the DuraBlend upholstery is both durable, and of similar quality, strength, and durability of leather.”

Isaac claims Ashley Furniture began marketing DuraBlend in 2008 as a leather substitute, with the same quality, strength and durability. The plaintiff says that he purchased a DuraBlend sectional sofa for about $1,100 in 2012 based on this marketing.

Contrary to Ashley’s marketing claims, the upholstery on the plaintiff’s sofa began to peel and disintegrate with normal use starting in 2015, alleges the class action lawsuit. The plaintiff says that he contacted Ashley about the disintegration of the DuraBlend sofa, but the store refused to issue a full refund.

This is the second class action to hit Ashley Furniture over DuraBlend. In November of last year, a plaintiff in Florida alleged Ashley “falsely, deceptively or misleadingly promoted, marketed, advertised, and sold furniture with DuraBlend.”

According to the class action complaint, “Ashley provided, disseminated, marketed, advertised or otherwise distributed false, deceptive or misleading information about the true nature, quality, or durability of the DuraBlend upholstery; and failed to disclose material information, or made material misrepresentations about, DuraBlend upholstery in connection with its promotion, marketing, advertising, and sale of that product.”

Ashley sold a variety of DuraBlend furniture, including sofas, loveseats, sections, and ottomans, says the plaintiff. These were marketed as “blended leather products,” alleges the complaint. The lawsuit includes a picture of the plaintiff’s cracked and peeling sectional sofa. Isaac alleges that he and other consumers would not have purchased or paid a much lower price for their DuraBlend furniture if they had known it was prone to peeling and disintegrating under normal use.

The plaintiff in the most recent class action seeks to represent a Class of Massachusetts residents who purchased DuraBlend furniture from Ashley Furniture. The plaintiff alleges that the company violated Massachusetts advertising law.

“Here, Defendants [sic] represented that furniture with DuraBlend upholstery sold to Mr. Isaac and other members of the class had characteristics that it does not have and that it was of a particular standard, quality, or grade, when in fact [it] was of lesser standard, quality, and grade,” alleges the Ashley Furniture class action lawsuit.

Isaac is represented by Josh Gardner and Nicholas J. Rosenberg of Gardner & Rosenberg PC.

    I live in Texas can I be included in the class action? I bought a DuraBlend sectional from Ashley Furniture in 12/2011 and it started peeling and deteriorating June 2017. I called them to see if it could be replaced and was told they dont make that sectional any longer and there was nothing they could do. I paid $1100 fir thus piece of crap.

    I have a sectional set from Ashley Furniture in Tukwila, WA. The chaise lounge started peeling immediately after the warranty expired. Now the chair next to the chaise is also peeling. I showed pictures to one of the sales people and he advised me to contact Customer Service and send them the pix. He told me they had reimbursed several people over this issue. The DURO BOND that they OVERSOLD us and many other people on. I wanted Microfibre and my husband wanted leather. The sales person RAVED about how great their new product DURO BOND was! He actually said it was like leather only better! I have read so many complaints exactly like mine. I called Customer Service and sent them the photos. The reply I got was “sorry, your warranty is expired, yadda, yadda, yadda”. One would NEVER buy a piece of furniture that would only last 5 yrs.! They clearly couldn’t care less about their customers. Any help/advise would be greatly appreciated!

    Illinois couches peeling. Ashley would not come out to see couch, but replaced arm rest when that was issue.
    What a waste of a lot of money. I’m embarrassed to have people over.

    How About Florida ? are we included since Ashley has sold over state lines thier products ? . Our couch has the same issues everyone is complaining about. Less than 2 years old. Couch with two recliners and a Love seat with two recliners. Ashley when I called about warranty claims product no longer made and no recourse now for us .

    I have a sofa, loveseat and a chair and half along with ottoman and everything is peaking. The business I bought it from went out of business right after I purchased it, but it was still purchased as an Ashley product. When I asked a store rep at the store that took over the original store and was an Ashley store, they said there was a problem with the glue used between the layers of leather, but said they couldn’t do anything and tried to sell me a new set. I would love to be informed if anyone has had any luck with this.

    I’m now living in Pennsylvania with the Ashley Furniture I purchased in Nebraska in September 2012. Cracking and peeling started late summer 2016, and the extended warranty (Guardsman) wouldn’t cover my claim. Would appreciate a notification if I am able to participate in the class action lawsuit. Would like my money back, and Ashley Furniture can have this junk couch and loveseat!

    I live in NH and am dealing with Ashley/Ashbrook furniture for the same durablend issue on my sectional I purchased in Nashua store in 2012. With barely any use, the material is peeling and disintegrating off the cushions. Looks horrible. I emailed the serial # on both pieces, included photos and the invoice to Ashley (cagroup@ashleyfurniture.com) for a store credit to resolve this issue. I have been dealing with them, consumer affairs, managers etc for a year now and have gotten nowhere. If you also service the state of NH, I would like to pursue this further.
