asbestos mesothelioma lawsuitAn asbestos mesothelioma lawsuit was recently filed against General Electric on behalf of a South Carolina man who died from lung cancer.

According to the mesothelioma lawsuit, Harold S. started work as a submarine welder at a Connecticut shipyard in 1966 and remained employed there for a number of years. His job duties allegedly exposed him regularly to products containing asbestos.

The mesothelioma lawsuit claims that the defendants’ asbestos-containing products led to Harold’s asbestos exposure, that the defendants were aware of the potential asbestos risk involved with these products, and that the defendants failed to warn their workers of the damaging and eventually fatal consequences linked with the use of their asbestos-containing products.

The defendants allegedly knew, even prior to when Harold began working at the shipyard, that their equipment, used by their workers, contained asbestos and was harmful and potentially fatal to those exposed to its fibers.

The asbestos exposure lawsuit claims that, had the decedent been adequately warned of the dangers of asbestos in the lungs, he would not have contracted mesothelioma and could have avoided a great deal of suffering.

Harold suffered from lung cancer, asbestosis, pleural effusions, and asbestos-related lung disease according to the asbestos mesothelioma lawsuit. The mesothelioma lawsuit further claims that, on top of these physical impairments, Harold suffered from significant pain and anguish.

Asbestos Mesothelioma

Asbestos is a naturally occurring mineral used for commercial purposes such as electrical or building insulation, as well as countless other uses. Asbestos’ microscopic fibers can accumulate in the lungs and cause several critical health problems, the worst of which is lung cancer.

Survival rates for mesothelioma patients are very low.

Mesothelioma is a cancer that attacks the lining of the lungs, and has been primarily associated with exposure to asbestos. Asbestos lung cancer takes decades to develop, but quickly spreads to other organs.

Because of these factors, asbestos lung cancer is commonly diagnosed at a late stage of development. The mesothelioma survival rate is about 40 percent after the first year past diagnosis. Mesothelioma survival rates really only improve with early detection rather than treatment options.

Of course, the mesothelioma survival rate varies by age, gender, and a number of other contributing factors.

Asbestos Mesothelioma Lawsuits

Most asbestos mesothelioma lawsuits are linked with workers who have been exposed to large amounts of asbestos over time. Mesothelioma is typically diagnosed years after initial exposure, and often in late stages of the disease.

Construction workers working in asbestos-contaminated areas can, through sawing, cutting, and other actions, release dangerous asbestos dusts and fibers into the air.

Asbestos dust and fibers became airborne on a regular basis, and could enter a worker’s lungs.

According to many asbestos mesothelioma lawsuits, the companies that allow their workers to be exposed to asbestos should have been aware of the dangerous nature of their asbestos-containing materials. Companies should also be aware of its ability to cause disease and even fatalities. There are many asbestos regulations in place to prevent these kinds of issues.

Many people exposed to asbestos, often construction workers, have filed asbestos mesothelioma lawsuits after being diagnosed with mesothelioma, searching for some kind of compensatory mesothelioma lawsuit payouts.

If you or someone you know has been diagnosed with or died from an asbestos-related disease, you may be able to file an asbestos mesothelioma lawsuit.

The Asbestos Mesothelioma Lawsuit discussed above is Daniels v. General Electric Company, et al., Case No. 3:16-cv-00199-JCH, in the U.S. District Court for the District of Connecticut.
