mercedes diesel emissionsA class action lawsuit claims that Mercedes Benz panoramic sunroofs are defective and randomly shatter, and that the car maker knows of the defect but actively avoids alerting consumers.

Plaintiff Giorgio Enea claims that in July 2015, he leased a new 2015 GLA250 Mercedes Benz that was equipped with a large sunroof.

The sunroof was advertised as being “panoramic” because it was larger than the average sunroof.  According to Enea, the sunroof randomly shattered while he was driving his vehicle on June 27, 2017, getting glass inside the car, as well as in his eyes and hair.

The plaintiff says he contacted Mercedes Benz for compensation. Allegedly, the company offered to cover his vehicle’s repairs only if he signed a liability release. He states that he refused to do so, and as a result, had to pay more than $2,000 out of pocket.

The Mercedes Benz shattering sunroof class action lawsuit claims that because Mercedes panoramic sunroofs are larger than a normal sunroof means they “pose unique engineering challenges” to be installed and used safely. Allegedly, the Mercedes panoramic sunroofs are defective in such a way that renders the vehicles unsafe and unfit for use.

The Mercedes sunroof class action lawsuit notes that the defective sunroofs are dangerous to drivers and passengers for a number of reasons. First, the plaintiff claims that as the glass spontaneously explodes, drivers and passengers can be hit with flying glass. Secondly, Enea says that the shock of having the sunroof shatter loudly and break throughout the car poses a serious distraction to drivers, putting them at increased risk of being involved in a collision.

Enea claims that Mercedes Benz refuses to compensate drivers for the defective sunroofs and knowingly neglects to warn consumers of the dangers and defects of the sunroofs. The plaintiff notes that through advertising, Mercedes Benz conveys to consumers that their vehicles are “luxury, top-of-the line cars, built to the highest standard, and were safe for their intended use.”

He goes on to state that this marketing is intentionally deceptive, and Mercedes Benz knew or should have known that the sunroofs are unsafe. To establish this claim, he cites the fact that panoramic sunroofs have a well-known record of being unsafe.

The Mercedes panoramic sunroof class action lawsuit notes that such panoramic sunroofs have been subject to recall in the past, when they were used by a number of other car manufacturers. Nissan, Hyundai, and Ford were among the manufacturers accused of installing defective panoramic sunroofs in their vehicles.

Enea seeks to have two Classes of California consumers certified as part of the Mercedes Benz shattering sunroof class action lawsuit — one group of consumers who have spent money “in connection with either the diagnosis or [the] repair” of their sunroof, and one group of consumers who “have not had the sunroof fully repaired.” He seeks damages for himself and similarly affected consumers.

The plaintiff is represented by Joshua H. Haffner and Graham Lambert of Haffner Law PC.

    I live in Victoria, Australia and own a 2017 Mercedes Benz C220d. I heard a loud bang in the morning at the time I had no idea what the noise was. My vehicle was parked in the garage attached to the house. It was cold day. My husband came home and went into the garage to find that my vehicle’s sunroof was cracked and shattered. The sunroof had exploded. The vehicle is 3 weeks out of the 3 years warranty. Mercedes Benz are saying that it must be because of a stone chip and want us to cover the cost for repairs.

    Happened to me today in my 2019 S Class 350 D AMG Line after 11,000 miles. Sunroof exploded without warning and showered me with glass. Had no idea that this was an issue until I Googled it! Seems crazy that a top end model still uses tempered glass when Volvo and Tesla have switched to laminate. I am in UK but won’t settle lightly for a vehicle at this price which is unsafe to drive – the dealer said they hadn’t seen the problem before if you have suggestion about how I might approach Mercedes for resolution I would be interested to hear.

    My panoramic sun roof just shattered on Saturday, September 12th, 2020, I have a 2017 C300, with 32,000 miles. I to contacted the Mercedes dealer and they acted like they had never heard of such a thing and also was told it was not covered under my warranty. I was only going between 50 and 55 and there we no cars in front of me to throw up any rocks. Also, the sunroof was closed, my friend and I heard a loud bang and the next thing we know glass came falling down. I too would like to be part of a class action suit.

      I was driving 20 miles on the ramp my panoramic sunroof shattered.
      Could you please let me what did you do anout it? Mercedes Benz they don’t repair under warranty.

    Had mine explode on the freeway in my 2015 S550, gonna cost me over $4k to fix. In 40 years of driving rocks hitting my windshield straight on at 70 mph has NEVER shattered them but supposedly one that could only glance off of the panoramic roof shattered it, really? And leave no glass inside my car while doing so?

    Same here! This is awful, how can you be one of the major luxury vehicles distributors in the world and safety if your clients are bare minimum, even after receiving concerns ?! Shame on you MB!

      Has anyone been contacted regarding this lawsuit? I have a 2007 Mercedes SL550 convertible that this just happened to. Luckily I was parked at a store and I heard this loud pop and the glass shattered all over. Can someone email me at ckjob1@gmail.com if this lawsuit is still going on? Thanks

        My 2017 E300 exploded while on the highway. What a scary feeling. I will take the car to the dealer see what they say. From reading the comments I doubt they’ll acknowledge as a defect.

    Today I was driving our 2019 GLC 300 and the sunroof just exploded. I was on the freeway and did not see any flying rocks or other debris. Thankfully the shade was closed. We bought our vehicle October 2019, it is garage kept and only has about 12.5k miles on it. The dealership first thought I was someone else because another Mercedes owner was bringing theirs in for the same issue. Top of the vehicle is all scratched up as well due to flying glass.

    2015 GLK glass panel between my sunroof and front window just burst! … i was drving on highway and then BOOM…pulled over and it has this huge crack in it and some pieces missing. Live in canada though hopefully this extends!

    I took my CLA250 into the dealer because my panoramic sunroof was jammed and the sunroof wouldn’t go down. My car was approximately 5 1/2 years old. Mercedes said it was not a defect and I paid $2327.36 to repair it on 5-2-2019. On 9-18-2019 the same thing happened. This repair was covered because I had a 2 year/24,000 mile warranty.

    My stepdad also has a CLA250 and his panoramic sunroof jammed and shattered. Mercedes covered his repair but now he’s having trouble with his panoramic sunroof jamming.

    This is clearly a defect to me and I feel I shouldn’t have been charged $2327.36 to fix the problem. I’m concerned this will happen again because Mercedes hasn’t fixed the design of the defected parts.

      I have a 2017 GLC 300. I never use the sunroof. I used it this weekend for the first time in a very long time. The sunroof will close but it is tilted open. I took my car to the dealer and they told me it was “off the rails” and that it would cost almost $4,000 to fix. I am very upset because I take very good care of the car and it has not been damaged in anyway. I am asking if they can just close it and I will have to decide what other options I have. But in the last hour I am reading that this is a common problem with the Mercedes/Webasto Roof Systems US. I am very angry now reading all of these comments. There is clearly a problem. Has anyone been contacted from this website or reached some resolution? I had planned to buy another Mercedes next year but now I am hesitant because they do not seem to be handling this issue correctly.

    GLS300 one month old and driving down the road Today and a loud bang and glass all over!!!! Cut arm and luckily had sunglasses on! Mercedes trying to say something must have hit it- no tow, no loaner – unbelievable!!!! Can’t wait to see who they think should pay for it!!!!!!!!
