Two men who were passengers in a pickup truck involved in an 18 wheeler accident in January have filed a lawsuit.
Plaintiffs Lucian “Jack” H. and Roy H. allegedly were passengers in a pickup truck that was waiting to make a left turn when Mark R. drove a car-carrier semi truck right into the back of the pickup. Mark was driving a 2016 Peterbilt tractor and a Cottrell car carrier trailer for URS Midwest, Inc.
The force of the 18 wheeler accident hit allegedly pushed the pickup truck into the path of oncoming traffic, and the pickup with the men inside was struck mainly on the passenger side by another vehicle, the complaint states.
Truck Accident Injuries
According to the 18 wheeler accident lawsuit, Jack and Roy suffered serious and severe injuries that might be permanent in nature. Jack’s injuries allegedly included trauma to the torso/trunk area; pain and damage to the low back and hips; difficulty walking, standing and bending; and other serious, severe personal injuries the full nature and extent of which are unknown.
Roy claims to have suffered the following injuries: trauma to the torso/trunk/groin area; worsening of a pre-existing hernia, requiring surgery; loss of bowel control; damage to his dentures, lips and soft palate; and other personal injuries of which the full nature and extent of are still unknown.
Both Jack and Roy allege that as a result of the 18 wheeler accident they have had to spend and will in the future be required to spend great amounts of money for healthcare needs and medical devices. They also claim they endured and will continue to experience significant physical pain in addition to mental and emotional distress.
The men allege their general health, strength and vitality have been impaired and that they have been permanently disfigured, and as such feel embarrassed, humiliated, and have suffered and will continue to suffer a loss of enjoyment of life.

Jack and Roy sought the assistance of a truck accident lawyer to pursue the 18 wheeler lawsuit that alleges the “negligence, carelessness and recklessness” of Mark R. caused their injuries.
Mark was employed by URS Midwest, Inc., which is accused of vicarious negligence in this case. Several allegations against Mark regarding his failure to avoid the accident are listed by the truck accident lawyer hired by Jack and Roy.
Among the allegations against Mark, the driver of the 18-wheeler:
- Failing to slow, stop, turn aside or otherwise take evasive action to avoid rear-ending the pickup truck
- Failing to keep the tractor-trailer under control at all times
- Failing to keep an adequate lookout for other vehicles on the road ahead of his
- Following too closely
- Being distracted
- Failing to sound a horn or provide any warning that he was about to collide with the pickup truck
The 18 wheeler accident lawsuit also alleges URS Midwest failed to establish safe, reasonable and required guidelines or safety instructions for its employees regarding the prevention of rear-end collisions and the safe operation of 18 wheelers.
