Mediant Communications agreed to a class action lawsuit settlement to resolve claims surrounding a 2019 data breach that exposed personal information.

The settlement benefits consumers who were notified that their personal information may have been compromised in a Mediant Communications data breach that occurred around April 1, 2019.

Mediant Communications offers investor communication services to a range of clients such as banks, advisors and funds. 

In May 2019, Mediant Communications announced it had been the victim of a data breach. The breach, which allegedly occurred through business email accounts, compromised sensitive investor information it had gathered while providing services to clients.

According to a class action lawsuit against the company, Mediant mismanaged the breach in a number of ways. The plaintiffs argue Mediant could have prevented the breach through reasonable cybersecurity measures but failed to do so. 

Additionally, the class action lawsuit challenges the company’s response to the breach. Plaintiffs claim Mediant’s data breach notification occurred nearly two months after the breach and failed to properly inform affected consumers how their information was compromised, how the breach occurred and other important information.

“By keeping affected individuals in the dark about the key details surrounding the Data Breach, Donnelley and Mediant have prevented affected individuals from taking meaningful, proactive, and targeted mitigation measures that could help protect them against severe harm,” the Mediant Communications class action lawsuit contends.

Mediant hasn’t admitted any wrongdoing but agreed to a class action settlement to resolve these allegations. The total settlement fund isn’t listed in the settlement agreement.

Under the terms of the settlement, class members can recover reimbursement for data breach-related losses. 

The settlement allows class members to claim up to $10,000 for unreimbursed losses, credit-related costs, miscellaneous expenses, mitigation efforts and more. This amount also includes documented time off work at a rate of $250 per hour, but class members can claim an additional five hours of time at a rate of $20 per hour for time they didn’t take off work but used to mitigate the data breach.

The settlement also provides two years of free credit monitoring to all class members, even if they didn’t sustain any losses as a result of the Mediant Communications data breach. 

The deadline for exclusion and objection is Oct. 3, 2022. 

The final approval hearing for the settlement is scheduled for Jan. 5, 2023. 

In order to receive free credit monitoring, class members do not need to submit a claim form and only need to enroll using their notice ID and email address on the settlement website.

In order to receive settlement payments, class members must submit a valid claim form by Nov. 21, 2022.

No proof of purchase is required, but documentation is needed to receive the maximum payout.
