The Urology Center of Colorado (TUCC) agreed to a class action settlement to resolve claims it was responsible for a 2021 data breach.
The settlement benefits individuals who received a notice that their personal identifying information may have been compromised in an Urology Center of Colorado data breach between Sept. 7 and 8, 2021. There are 137,820 people who received a data breach notice.
The Urology Center of Colorado is a Denver-based clinic that offers treatment and support for a number of urological conditions. The center boasts 20 highly qualified physicians and state-of-the-art radiation technology.
In November 2021, the Urology Center of Colorado notified authorities that an unauthorized party had gained access to sensitive patient data between Sept. 7 and 8, 2021.
An internal review reportedly found the data breach compromised names, birth dates, Social Security numbers, addresses, contact information, insurance data, healthcare information and more.
Consumers quickly took legal action against the health care center, arguing its negligence led to the data breach. According to the plaintiffs, reasonable cybersecurity measures would have prevented the data breach and kept their information secure.
“Plaintiffs’ and Class Members’ identities are now at risk because of [TUCC’s] conduct since the private information that [TUCC] collected and maintained is now in the hands of data thieves,” the data breach class action contends.
The Urology Center of Colorado hasn’t admitted any wrongdoing but agreed to resolve these allegations with a class action settlement. The total settlement fund isn’t disclosed.
Under the terms of the TUCC settlement, class members can receive reimbursement for out-of-pocket expenses.
The settlement terms allow for up to $500 for ordinary out-of-pocket expenses such as bank fees, communication expenses, credit monitoring, professional fees and more.
Class members can collect larger reimbursements of $2,500 for extraordinary expenses including unreimbursed fraudulent charges and damages due to identity theft. Class members who lived in California at the time for the data breach can collect an additional $50 statutory payment.
All class members are eligible for two years of IDX credit monitoring and identity theft protection. Individuals who previously enrolled for protection offered by the Urology Center of Colorado will automatically be enrolled in the extended settlement benefits. Those who did not previously enroll will need to submit a claim to enroll.
The deadline for exclusion and objection is Oct. 10, 2022.
The final approval hearing for the Urology Center of Colorado settlement is scheduled for Oct. 26, 2022.
In order to receive TUCC settlement benefits, class members must submit a valid claim form by Nov. 7, 2022.
