Mazda class action lawsuit overview:

  • Who: Plaintiff Daniel Green has filed a class action lawsuit against Mazda Motor of America Inc. and Mazda Motor Corp.
  • Why: Green claims Mazda Motor of America and Mazda Motor Corp. failed to disclose that its CX-90 vehicles contain a defect that impedes braking performance.
  • Where: The Mazda brakes class action lawsuit was filed in California federal court.

A new class action lawsuit alleges that Mazda Motor of America Inc. and Mazda Motor Corp. failed to disclose that its CX-90 vehicles contain a defect that impedes braking performance.

Plaintiff Daniel Green claims Mazda failed to disclose that the 2024 and 2025 model year CX-90 vehicles contain a defect that causes the braking system components to become “severely worn and damaged” and may lead to a complete failure of the braking system.

Green claims the defect causes the brakes to make loud, high-pitched noises and requires frequent replacement or repair of the braking system components. 

He argues that the defect poses a safety risk to drivers and passengers, as it can lead to decreased braking performance and longer stopping distances.

Green wants to represent a nationwide class and New York subclass of current and former owners and lessees of 2024-2025 Mazda CX-90 vehicles.

Mazda failed to disclose brake defect until vehicles were sold, class action claims

Green argues that Mazda knew or should have known that the CX-90 vehicles contain a defect, but failed to disclose the issue at the time of sale or lease, repair, and thereafter.

The Mazda class action lawsuit alleges the company refuses to acknowledge the defect or provide a permanent fix. Instead, Mazda performs repairs that mask the problem until the vehicle’s warranty expires. As a result, plaintiffs claim they are forced to pay for repairs out of pocket and to continue driving unsafe vehicles.

“Indeed, many owners and lessees of Class Vehicles, including Plaintiff, have communicated with Mazda and its agents to request that they remedy and/or address the Brake Defect,” the Mazda class action says.

Green claims Mazda is guilty of breach of express and implied warranties and of violating the Magnuson-Moss Warranty Act, California’s Consumer Legal Remedies Act, California’s Unfair Competition Law and California’s False Advertising Law.

He demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory, treble and punitive damages for himself and all class members.

Recently, another class action lawsuit against Mazda claims Mazda misrepresented speaker and radio features in its Mazda3 models.
