Maxim Healthcare Services Inc. is facing a putative class action wage and hour lawsuit recently filed by a woman alleging violations against California labor laws.
Plaintiff Maria D. is leading this putative class action wage and hour lawsuit against Maxim Healthcare, alleging the company did not pay employees overtime or give meal breaks in violation of California labor laws.
Under California labor laws, non exempt employees are guaranteed an increased rate of one and one half of their hourly rate if they work over 40 hours a week or eight hours in a single workday. In addition, California labor laws state that employers need to give employees 30 minute meal breaks every five hours and a 10 minute rest period every four hours.
If employees work through meal breaks or have to perform work during these designated rest periods, then an extra hour of pay must be added to their paychecks, alleges the class action lawsuit. The putative class action wage and hour lawsuit says that Maxim Healthcare failed to provide these breaks or overtime.
According to the class action lawsuit, Maxim Healthcare is a medical staffing agency that provides labor and services throughout the state of California. Maxim Healthcare employees are divided up into two categories: Staffing and Homecare, with Staffing employees placed in client facilities and Homecare employees placed in customers’ homes.
At all times relevant, Maria says she worked as a full time staff employee at various work sites in Los Angeles County, Calif.
Overview of Putative Class Action Wage and Hour Lawsuit
According to the putative class action wage and hour lawsuit, Maria had worked for Maxim Healthcare from July 2013 until her termination in December 2014. During her employment, Maria worked as a staff employee at the HarborUCLA Medical Center and Rancho Los Amigos National Rehabilitation Center and was paid $13 per hour.
Maria alleges that she and other employees were forced to work without compensation. They were required to work before their scheduled shifts, but Maxim allegedly did not pay them for the extra time.
Maria further alleges that she and other employees were regularly denied meal breaks and rest periods, sometimes working for eight hours without a break. Maria alleges that she and other employees had been instructed to fill out time sheets at home at the end of each work week, and then send them to Maxim Healthcare for payment processing.
She claims that even though Maxim Healthcare had these time sheets and was aware of the off the clock hours, the missed meal breaks, and overtime hours, the company still allegedly failed to pay employees for this time.
Maria filed this putative class action wage and hour lawsuit on behalf of herself and other employees, and is seeking compensation for all missing wages and damages related to violations against California labor laws.
The Wage and Hour Class Action Lawsuit is Case No. 2:18-cv-05619-AB-E, in the Superior Court of California, Los Angeles County.

Who can I contact so I can be removed from this class action
Maxim needs to be held liable period. I was the Director there and some of the nurses had been working with out turning Drs orders in it would do their own thing. So needless to say I was not liked because I changed all of this. I worked a ton over and it was never good enough for the Regional Director but she didn’t realize or believe me when I would tell her things were a mess there. Consents were not up to date in their charts meds had the wrong classification assigned to them
Maxim Healthcare has caused me a great amount of issues, from making mistakes with contracts that fell through to making mistakes in their benefits department etc…they have done wrong and they need to be held liable.
Maxim is classifying me incorrectly in order not to pay overtime. Despite millions in class action lawsuits being found against Maxim they are continuing the practice. I learned from another agency never sue of they won’t give you work. And it won’t help that you could collect for retaliation. No ethics, no laws to protect.
