The makers of the Biomet Magnum M2a, Biomet Orthopedics LLC, face a lawsuit in South Dakota federal court by a man over allegations that he suffered severe adverse side effects involving a defective hip implant system.
Plaintiff Thomas R. is filing the Biomet Magnum M2a lawsuit as a citizen and resident of Tea, S.D. The lawsuit was filed on Oct. 22, 2018, and Thomas demands a trial by jury.
According to the Biomet Magnum M2a lawsuit, Thomas says that he underwent a left hip replacement surgery at Sioux Falls Specialty Hospital on March 4, 2010. It was there that a Biomet M2a-Magnum metal-on-metal prosthesis was placed.
However, he soon suffered severe adverse side effects that required him to undergo a costly and painful revision surgery on Oct. 16, 2017. He says that he relied on the company’s representations in addition to his orthopedic surgeon’s representations that the device was safe and effective.
“Having to go through a revision surgery has subjected Plaintiff to much greater risks of future complications than he had before the revision surgery,” the Biomet Magnum M2a lawsuit states.
Thomas says that he “sustained and continues to suffer economic damages (including lost wages, medical and hospital expenses), severe and possibly permanent injuries, pain, suffering and emotional distress.”
The Biomet Magnum M2a lawsuit was filed on multiple counts including strict product liability, negligence, breach of implied warranties, breach of express warranty and Violation of South Dakota Consumer Protection Act.
Overview: Biomet Magnum M2a
Hip replacement devices allow individuals to live pain-free and regain any lost mobility that they may have had. However, in many instances they can also lead to patients suffering intolerable health issues and lead to many complications. The risks that patients face may vary depending on the type of hip replacement devices that are used.
The Biomet Magnum M2a is a hip system device under scrutiny for the number of health issues that have been linked to it. In fact, in 2011, the Australian Joint Registry reported that patients implanted with the Biomet Magnum M2a had a 7.2 percent revision rate, a number a lot higher than ordinary metal-on-polyethylene systems.
The British Medical Journal also noted than there are higher rates of revision surgeries associated with metal-on-metal hip replacement devices than other systems.
Thousands of plaintiffs have suffered severe adverse side effects and complications associated with the Biomet Magnum M2a hip implant device. The Biomet Magnum 2a carries with it the potential of depositing shards of chromium and cobalt into neighboring tissues.
These pieces can migrate into the bloodstream and tissue causing a multitude of symptoms. Some of these symptoms include inflammation, rash, swelling, difficulty walking, tissue death and pain.
Some of other adverse side effects have included:
- Hip pain
- Loosening
- Trouble standing or walking
- Difficulty bearing weight
- Hip revision surgery
- Metal poisoning, also known as metallosis
The Biomet Magnum M2a Lawsuit is Case No. 4:18-cv-04136-KES, in the U.S. District Court for the District of South Dakota, Southern Division.
