Multiple states are filing a generic drug lawsuit against various manufacturers, alleging serious antitrust violations. The generic drug lawsuit is naming six different manufacturers as defendants, including the makers of a commonly-used antibiotic and an oral diabetes medication.
The states allege these companies fixed prices on their products and conspired among themselves to maximize profits from the market place. The companies named in the generic drug lawsuit include Heritage Pharmaceuticals, Inc., Aurobindo Pharma USA, Inc., Citron Pharma, LLC, Mayne Pharma (USA), Inc., Mylan Pharmaceuticals, Inc. and Teva Pharmaceuticals USA, Inc.
According to the generic drug lawsuit, these companies violated state and federal antitrust laws by allegedly price-fixing their products to force consumers to pay more for their products.
By doing this the companies had allegedly violated the West Virginia Antitrust Act, which prohibits contracts or conspiracies between different companies to conduct pricing fixing, and controlling or maintaining market prices of any product or service. The generic drug lawsuit was partially initiated after investigators noted price markups in certain generic drugs.
The investigation discovered potential evidence of the companies collaborating together for years, to allocate markets for various ventures including the delayed release of doxycycline hyclate antibiotic and oral diabetes medication glyburide.
The plaintiff states involved in this generic drug lawsuit are West Virginia, Arkansas, Missouri, New Mexico, Connecticut, and the District of Columbia.
Overview of Generic Drug Lawsuit
This generic drug lawsuit comes after the Justice Department and state Attorneys General had conducted an investigation into certain generic drug manufacturers, which allegedly found evidence of price fixing between 2014 and 2017.
These generic drug manufacturers had allegedly illegally increased the prices of these drugs to maximize on profits. Executives of these companies had directly contacted each other, and had allegedly established a common trade association agreement.
Manipulating generic drug prices can be potentially devastating, with a 2012 report by the Government Accountability Office (GOA) stating generic drug prices were 75% lower than their name brand counterparts. The lower price allows consumers seek these generic drugs for treatment when they can not afford the name brand drugs.
According to Maryland Representative Elijah Cummings and Vermont Senator Bernie Sanders, generic drug prices increased by a staggering 388% and 8,281% between October 2013 to April 2014. The generic drugs primarily affected by these pricing increases include treatments for cardiac condition, seizures, asthma, lung conditions, infections, and other serious ailments. Patients who cannot afford to purchase these drugs, can potentially be put in danger.
