Man Wins Nearly $8.5 Million in Home Depot Personal Injury LawsuitA New York man was recently granted a $1.8 million award (on top of $6.6 million he had previously been awarded) through his Home Depot personal injury lawsuit.

According to the Home Depot personal injury lawsuit, the plaintiff, Daniel R., was injured in an accident while working as a subcontractor for Home Depot at a construction site in New York in 2015. While on a ladder, Daniel suffered an electric shock and fell, leading to serious injuries necessitating surgery and incurring substantial medical expenses.

According to Daniel’s Home Depot personal injury lawsuit, his injuries were the result of violations of state labor laws. While Daniel only named Home Depot in his lawsuit, and the home improvement company was found statutorily liable for the accident, the company brought another complaint against the plaintiff’s direct employer, Bryan’s Home Improvement Corp. This means that Home Depot can now seek indemnification from the subcontractor for the damages that it must award Daniel for his Home Depot personal injury lawsuit.

Daniel was granted the $1.8 million award to help compensate for past and future pain and suffering. $135,000 was allotted for past pain and suffering, while $1.71 is meant for future damages. He had previously been awarded $6.6 million in economic damages to cover future medical costs and other expenses.

Work injuries like Daniel’s can be devastating, but those who have suffered from injuries at work may find that filing a personal injury lawsuit can help them with compensation. Personal injury claims, like this work injury lawsuit, rest on the concept of negligence—that is, the idea that another party’s negligence or carelessness led directly to your injuries.

Negligence is legally defined as “the failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances to protect oneself or others from bodily injury, death, property damage.”

Filing a Personal Injury Lawsuit

A work injury lawsuit like Daniel’s is a common form of personal injury litigation. Other personal injury lawsuits include birth injuries, slip and falls, dog bites, medical malpractice, and car accidents, among many others.

If you have a personal injury claim and want to seek compensation, you may be able to file a lawsuit. A personal injury lawsuit can help compensate for medical bills, lost income, physical pain and suffering, loss of enjoyment of life, disability or disfigurement, property damage, emotional distress, and/or wrongful death. Filing a personal injury lawsuit cannot take away the pain and suffering caused by injuries, but it can help to alleviate the financial burden caused by medical expenses and lost wages.

The Home Depot Personal Injury Lawsuit is Case No. 1:16-cv-07552, in the U.S. District Court for the Southern District of New York.
