A California man recently filed a long term disability lawsuit against insurance giant Unum alleging he was illegally denied his rightful benefits.
Plaintiff Patrick G. says he was covered under an Unum group disability insurance policy through his work, which would provide 60 percent of his gross monthly earnings should he become disabled long-term.
Unfortunately according to this long term disability lawsuit, in February 2017, Patrick suffered from pancreatitis, which necessitated multiple surgeries and resulted in chronic pain, cognitive impairment and even several weeks spent in a coma.
Because of these injuries, he became totally disabled, and filed for long term disability benefits according with his Unum insurance plan. At first, Unum paid Patrick his benefits for a period of several months. But then, in November 2017, his claim was denied and his benefits terminated.
Patrick first attempted to appeal the denial, claiming it was wrongful, but Unum denied that appeal as well. He then filed a long term disability lawsuit against the insurance giant, alleging it operated under a conflict of interest and that the denial was wrongful under the agreed-upon terms of the benefits plan, as he was totally disabled as defined by the plan.
Patrick filed his long term disability lawsuit in the hopes of receiving the benefits he is due and for attorneys’ fees that have been incurred as a result.
The Unum long term disability lawsuit was filed on Aug. 30, 2018, in the U.S. District Court for the Northern District of California.
Filing an Unum Long Term Disability Lawsuit
A growing number of plaintiffs like Patrick are filing disability benefits lawsuits against Unum, claiming that the insurance giant unfairly denied their disability claims to benefits that they actually qualify for under the terms of their insurance policies, often provided by employers.
This Unum long term disability lawsuit and others like it allege that Unum, as the largest disability insurance company in the country, has unfairly denied the disability insurance claims of plaintiffs like Patrick who are in fact qualified to receive such benefits.
Some lawsuits even allege that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit. Former employees of Unum have reported being instructed to purposely deny insurance to people with legitimate claims to disability benefits in order to fulfill the company’s quota.
