A South Carolina man recently turned to litigation after he found his heart disease disability claim was denied by the Paul Revere Life Insurance Co., alleging he was wrongfully denied.
The plaintiff, Michael P., purchased an insurance policy through Paul Revere Life Insurance on Oct. 20, 1984, which was to cover any future disability. Decades later, Michael says he became disabled in the year 2016 due to coronary artery disease. He submitted his heart disease disability claim in October 2017, providing medical records and other information about his disability. However, the company denied his claim for benefits.
According to the lawsuit, this heart disease disability claim was wrongfully denied, and Paul Revere Life Insurance Co. is improperly withholding Michael’s benefits. After his claim was denied, Michael turned to litigation against the insurance company in the hopes of regaining his benefits. Unum Group was also named in the lawsuit as the third-party adjuster used to handle his insurance claim.
Michael filed his heart disease disability claim lawsuit on July 6, 2018, in the South Carolina Court of Common Pleas. The lawsuit was filed on breach of contract and breach of the covenant of good faith.
Michael is not the first person to have been denied Unum long-term disability benefits he should have received under their life insurance policy. Some who have become disabled seek reinstatement of their disability benefits by pursuing all the administrative means available to them, including filing appeals to reverse their insurer’s decision.
However, even when a person attempts to appeal in this manner, the insurer may still deny their appeal. If the appeal approach proves unsuccessful, some turn to legislative means to seek the company’s claim denial reversal going forward.
This heart disease disability claim lawsuit and others like it allege that insurers like Paul Revere and Unum have unfairly denied the disability insurance claims of plaintiffs who are qualified to receive such benefits. Some lawsuits go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit.
