lung and asbestos exposureA plaintiff has filed a lawsuit in a California federal court alleging personal injury and negligence in an asbestos exposure lawsuit.

Plaintiff Jimmie Lee L. files the lawsuit and alleges these damages among several others against his former employees and defendants, A.W Chesterton Company and  Air & Liquid Systems Corporation.

According to the asbestos exposure lawsuit, Jimmie states that he had “sustained an asbestos-related lung disease by the inhalation of asbestos fibers released during the handling of asbestos-containing products, including at plaintiff’s worksites.”

The asbestos exposure lawsuit contends that he had repeated exposure to asbestos-containing products due to his working at the defendant’s worksites over a period of many years. Because of the repeated exposure to the toxic asbestos fibers, Jimmie was made to contract an “incurable lung disease.”

However, the plaintiff does not blame his development of lung disease from the asbestos containing products themselves, but on the manner and handling of which he was required to work with them.

Asbestos Mesothelioma Facts

Mesothelioma is an aggressive form of cancer that develops in the tissue that lines the lungs, stomach, or heart. When healthy mesothelial cells are exposed to asbestos fibers, it causes genetic mutation wherein mesothelioma tumors develop and replicate rapidly.

Reports say that the most common form of mesothelioma is the malignant form. It requires lab tests and a medical diagnosis and although treatment may slow down its progression, it cannot be cured. Treatment of a mesothelioma diagnosis includes radiation, surgery, and chemotherapy.

Symptoms of a person who has developed mesothelioma includes: difficulty swallowing; bowel obstruction; fatigue; chest pain; shortness of breath; fluid buildup; and pain near the tumor.

The most common occurrence of an individual developing mesothelioma often happens while they are working. Such workplaces where exposure to asbestos fibers may be common include places such as public buildings, schools, industrial settings, auto repair shops, old houses, and shipyards.

What is most common in developing mesothelioma is the long-term exposure to asbestos. However, short-term exposure and a one-time exposure is also reported to lead to the incurable lung disease.

According to reports, physicians diagnose roughly 3,000 people annually with mesothelioma. The sources of these cases are often due to job-related asbestos exposure. While the number of people who have contracted mesothelioma from an asbestos-related exposure has dropped in recent years due to workplace safety laws, physicians are still finding people with mesothelioma.

The cancer, in fact, may take about 20-50 years to appear because of an asbestos-related exposure. And, although a cure has yet to be developed, advances in medicine have proved to have increased the understanding of a mesothelioma diagnosis and further improve treatment in treating the diagnosis.

The plaintiff files the following damages against the defendants: 1) Negligence, 2) Strict Products Liability, 3) False Representation, and 4) Intentional Tort/Intentional Failure to Warn/Concealment.
